I, JENNY MACKLIN, Minister for Families, Housing, Community Services and Indigenous Affairs make this Determination under section 35A of the Social Security Act 1991. [1]

[1] This Determination has effect in relation to provisions of the Social Security Act 1991 in so far as they relate to matters for which I have responsibility for under the Administrative Arrangements Order.

  1. Name of instrument

This Determination is the Social Security (NSW Lifetime Care and Support Scheme – Self-purchasing of treatment, rehabilitation and care services) (FaHCSIA) Determination 2011.

  1. Commencement

This Determination commences on the day after it is registered.

  1. Interpretation

   In this Determination:

Act means the Social Security Act 1991.

NSW Lifetime Care and Support Scheme – Self-purchasing of treatment, rehabilitation and care services is a scheme for the provision of personal care support administered by the Lifetime Care and Support Authority of New South Wales constituted under the Motor Accidents (Lifetime Care and Support) Act 2006 (NSW), under which the Authority pays an amount to cover the reasonable cost of treatment, rehabilitation and care services of the participant related to the participant’s motor accident injury.

treatment, rehabilitation and care services means the participant’s needs for or in connection with any of the following:

(a)medical treatment (including pharmaceuticals);

(b)dental treatment;

(c)rehabilitation;

(d)respite care;

(e)attendant care services that aim to provide assistance to the participant for everyday tasks, and includes personal assistance, nursing, home maintenance and domestic services;

(f)domestic assistance;

(g)aids and appliances;

(h)artificial members, eyes and teeth.

  1. Determination of a scheme

NSW Lifetime Care and Support Scheme – Self-purchasing of treatment, rehabilitation and care services is an approved scheme.

Note: Paragraph 8(8)(zi) provides that a payment towards the cost of personal care support services for the person, being a payment made under a scheme approved under section 35A, is not income for the purposes of the Act.
