Part 1        Preliminary

1   Name of Determination

This Determination is the Social Security Exempt Lump Sum (Dependant Pension Lump Sum Payment and Closure) (FaHCSIA) Determination 2009.

2   Commencement

This Determination commences on the 24 September 2009.

3   Definitions

In this Determination:

Act means the Social Security Act 1991.

dependant pension is a form of pension paid under the Repatriation Act 1920.

Part 2        Exempt Lump Sums

4   Amount or class of amounts

If a person, who was eligible for, and in receipt of dependant pension in respect of 22 September 2009, receives a one-off payment of dependant pension from the Department of Veterans’ Affairs in consideration of the cancellation of their ongoing fortnightly dependant pension payments, then the amount of that one-off lump sum payment is an exempt lump sum, in respect of the person, for the purposes of the Act.
