1  Name of Determination

This instrument is the Social Security (Assurances of Support) Amendment Determination 2018 (No. 2).

2  Commencement

(1)Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1 amends the Social Security (Assurances of Support) Determination 2018.

Schedule 1 – Amendments

Social Security (Assurances of Support) Determination 2018

1. Section 24

Repeal the section, substitute:

24  Periods for which assurances of support remain in force

For subparagraph 1061ZZGF(1)(b)(i) of the Act, the following periods are specified:

(a)  for an assurance of support for a Subclass 143 (Contributory Parent (Migrant)) (Class CA) visa or a Subclass 864 (Contributory Aged Parent (Residence)) (Class DG) visa – 10 years;

(b)  for an assurance of support for a Community Support Programme entrant – 12 months;

(c)  for an assurance of support for a Subclass 115 (Remaining Relative) (Class BO) visa,  Subclass 835 (Remaining Relative) (Class BU) visa, Subclass 117 (Orphan Relative) (Class AH) visa or Subclass 837 (Orphan Relative) (Class BT) visa – 2 years;

(d)  in any other case – 4 years.

1. Application provision

The amendment made by item 1 of this Schedule applies to an assurance of support given under Chapter 2C of the Social Security Act 1991 on or after the commencement of this instrument.

Note: Any assurance of support given under Chapter 2C of the Social Security Act 1991 before commencement of this instrument will remain in force until the end of the period specified in section 24 of the Social Security (Assurances of Support) Determination 2018 prior to commencement of this instrument.
