1  Name

This instrument is the Social Security Amendment (Class of Visas – Newly Arrived Resident’s Waiting Period for Special Benefit) Determination 2018.

2  Commencement

(1)Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made for the purposes of paragraphs 739A(1)(e) and 739A(4)(b) of the Social Security Act 1991.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Social Security (Class of Visas – Newly Arrived Resident’s Waiting Period for Special Benefit) Determination 2015 (No. 2)

1  After section 4

Insert:

4A Classes of visas for the purposes of paragraph 739A(1)(e) of the Act

For the purposes of paragraph 739A(1)(e) of the Act, classes of visas are:

(a)Subclass 309 (Partner (Provisional)); and

(b)Subclass 820 (Partner).

2  After section 5

Insert:

5A Classes of visas for the purposes of paragraph 739A(4)(b) of the Act

For the purposes of paragraph 739A(4)(b) of the Act, classes of visas are:

(a)Subclass 309 (Partner (Provisional)); and

(b)Subclass 820 (Partner).
