  1. Name of Specification

This Specification is the Social Security (Administration) (Deductible portion — section 123XI) Specification 2009.

  1. Commencement

This Specification commences on 7 March 2009.

  1. Revocation of previous Specification

The Social Security (Administration) (Deductible portion — section 123XI) Specification 2008 is revoked.

4              Definitions

In this Specification:

Act means the Social Security (Administration) Act 1999.

Note 1Baby bonus is defined in subsection 3(1) of the Family Assistance Act and has the same meaning in this Specification as in that Act.

Note 2Category I welfare payment is defined in section 123TC of the Act and has the same meaning in this Specification as in the Act.

Note 3Family Assistance Act is defined in subsection 23(1) of the Social Security Act 1991 and has the same meaning in this Specification as in that Act.

5              Deductible portion

For paragraph 123XI(3)(b) of the Act, the lower percentage of 70% is specified as the deductible portion of an instalment of a category I welfare payment, other than the following category I welfare payments:

(a)   baby bonus under the Family Assistance Act;

(b)   a payment under the scheme known as the ABSTUDY scheme that includes an amount identified as living allowance;

(c)    a payment under the scheme known as the ABSTUDY scheme that includes an amount identified as pensioner education supplement.
