Act No. 72, 1989

An Act to amend the Soccer Football Pools Act 1975 and the State Lotteries Act 1930 to enable the State Lotteries Office to promote, conduct and operate soccer football pools; and for other purposes. [Assented to 29 May 1989]

Soccer Football Pools (Amendment) 1989

The Legislature of New South Wales enacts:

Short title

1.          This Act may be cited as the Soccer Football Pools (Amendment) Act

1989.

Commencement

2 ,

This Act commences on the date of assent.

3. The Soccer Football Pools Act 1975 is amended as set out in

Schedule 1.

Amendment of State Lotteries Act 1930 No. 51

4. The State Lotteries Act 1930 is amended as set out in Schedule 2.

SCHEDULE 1—AMENDMENT OF SOCCER FOOTBALL POOLS

ACT 1975

(Sec. 3)

(1) Section 6 (Licence to promote soccer football pools)—

After section 6(3), insert:

(3a) The Minister may, without requiring compliance with the provisions of subsections (l)-(3) or any of them, grant to a statutory body representing the Crown a licence to promote, conduct and operate soccer football pools either unconditionally or subject to conditions of which the statutory body was notified by the Minister in writing before the granting of the licence.

(2) Section 14b

After section 14a, insert:

Agreement by licensed statutory body

14b. (I) A statutory body holding a licence under section 6 (3a) may, on such terms and conditions as are approved by the Minister, enter into an agreement with an interstate authority with respect to—

(a)

the administration of a scheme for the promotion, conduct and operation of soccer football pools among participating States; and

(b)

the manner of making payments to and by the licensee as referred to in section 15 (2a) and (3) (al); and

(c) related matters. (2) In this section— “interstate authority” means a person who is authorised to

promote, conduct and operate soccer football pools in a

participating State,

(3) Section 15 (Prize fund)—

(a)

Section 15 (2a)— After section 15 (2), insert:

(2a) a licensee shall pay into the prize fund any amount that, in accordance with an agreement under section 14b, is paid to the licensee towards payment by the licensee of prizes won in accordance with soccer football pools promoted, conducted and operated by the licensee.

(b)

Section I5{3)(al)—

After section 15 (3) (a), insert:

(al) towards the payment, by the person promoting, conducting and operating a soccer football pool under a corresponding law, of prizes won in accordance with soccer football pools promoted, conducted and operated by that person in a participating State;

SCHEDULE 2—AMENDMENT OF STATE LOTTERIES ACT 1930

(Sec. 4)

Section 6 b (The State Lotteries Office)—

After section 6b (4), insert:

(4a) Without affecting any other of its functions, the Office

may—

(a)

hold a licence under the Soccer Football Pools Act 1975; and

(b)

exercise the functions of a licensee under that Act, including functions exercisable outside the State.
