An Act to amend the Soccer Football Pools Act 1975 with respect to the

Soccer Football Pools (Amendment) 1986
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:
Short title
1. This Act may be cited as the "Soccer Football Pools (Amendment)
Act 1986".
Commencement
2. (1) Except as provided by subsection (2), this Act shall commence
on the date of assent to this Act.
(2) Schedule 1 (3), and section 3 in its application to that provision, shall
be deemed to have commenced on 20 April 1986.
Amendment of Act No. 45, 1975
3. The Soccer Football Pools Act 1975 is amended in the manner set
forth in Schedule 1.

(Sec. 3)
AMENDMENTS TO THE SOCCER FOOTBALL POOLS ACT 1975
(1) Section 2 (Interpretation)— Definition of "financial year"—
After the definition of "entry form", insert:
"financial year" means a year commencing on 1 July;
(2) Section 6 (Licence to promote soccer football pools)—
(a) Section 6 (3)—
After "section 14(1) (b)" wherever occurring, insert "or (c)".3 Act No. 192

(b) Section 6 (4)— Omit the subsection, insert instead:
(4) Subject to this Act, a licence is in force during—
(a) the period specified in the licence; and
(b)
a further period or periods, if any, for which it is extended by instrument in writing signed by the Minister, being a period which does not, or periods which in the aggregate do not, exceed 10 years.
(3) Section 14 (Application of subscriptions)—
(a) Section 14 (1) (a)— Omit "and",
(b) Section 14 (l)(b), (c)—
Omit section 14 (1) (b), insert instead:
(b) unless provision is made by the regulations for the payment of duty, pay to the Minister as duty— (i) if the total subscriptions received in New South Wales and elsewhere in respect of soccer football pools have, in the financial year in which the pool is conducted or in any previous financial year (being a year commencing on or after 1 July 1986), reached $104,000,000, an amount equal to 0.35 x S; or

(ii) in any other case, an amount equal to 0.34 x S and, if the subscriptions received in New South Wales and elsewhere in respect of the pool exceed $1,000,000, an additional amount equal to—

S is the amount of subscriptions received in New South
Wales in respect of the pool; and
N is the amount of subscriptions received in New South
Wales and elsewhere in respect of the pool; and
(c)
if provision is made by the regulations for the payment of duty, pay duty to the Minister in accordance with the regulations.
(c) Section 14 (3)— Omit "the amount referred to in subsection (1) (b)" wherever occurring, insert instead "the duty payable under subsection (1)".
(d) Section 14 (4) (a)—
Omit "(b)".(e) Section 14 (4) (b)—
Omit the paragraph, insert instead:
(b)
referred to in subsection (3) (b) has been entered into, the licensee's obligations under subsection (I) are subject to any modifications effected by the agreement.

(4) Section 14A—
After section 14, insert:
First year of payment of higher duty14A. (1) In this section, "additional duty", in relation to a soccer football pool, means an amount of duty equal to the difference between the amount of duty referred to in section 14 (1) (b) (i) and the amount of duty referred to in section 14 (1) (b)
(ii), calculated in respect of the pool.
(2) If at the close of entries to a soccer football pool conducted in a financial year commencing on or after 1 July 1986 the total subscriptions received in New South Wales and elsewhere in respect of soccer football pools conducted in that financial year reach $104,000,000, the licensee shall pay to the Minister, within 7 days after the day on which those entries close, additional duty in respect of each soccer football pool conducted by the licensee in the period of that financial year occurring before that day.
(3) The additional duty may be paid out of subscriptions
received before the day referred to in subsection (2) or otherwise.(4) Subsections (3) and (4) of section 16 apply to additional duty unpaid after the 7-day period referred to in subsection (2) in the same way as they apply to the payment of duty referred to in section 16 (1) which is not made within the time specified in section 16 (1).
