SOCCER FOOTBALL POOLS ACT 1975—REGULATION

(Soccer Football Pools (General) Regulation 1996)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Soccer Football Pools Act 1975, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Soccer Football Pools (General) Regulation 1996.

Commencement

2. This Regulation commences on 15 April 1996.

Definition

3. In this Regulation:

“the Act” means the Soccer Football Pools Act 1975.

Application of subscriptions to prize fund

4. For the purposes of section 14 (2) (b) of the Act, the prescribed percentage is 50%.

Unclaimed soccer football pool prizes

5. (1) In this clause:

“unclaimed prize” means a prize that remains unclaimed by the

prizewinner for a period of 2 years after the date on which the soccer
football pool to which the prize relates is conducted.

(2) The licensee is to cause to be published in the Gazette, at least once in each year, a list containing the following particulars of each unclaimed prize of $50 or more won on a soccer football pool:

(a) the value of the prize;
(b) the name of the prizewinner, if known;
(c) the game number of the soccer football pool concerned.
(3) The licensee who conducted the soccer football pool and holds an

unclaimed prize may dispose of funds arising from it by applying those funds in payment of special or bonus prizes, as determined by the licensee.

(4) The disposal of an unclaimed prize under this clause does not affect

a prizewinner’s entitlement to the prize.

Repeal

6. The Soccer Football Pools (Application of Subscriptions)

Regulation 1994 is repealed.

EXPLANATORY NOTE

The object of this Regulation is to make provision for general matters under the

Soccer Football Pools Act 1975 (“the Act”).

This Regulation deals with the following:

(a)

the percentage of subscriptions to be paid to the prize fund: under section 14 of the Act, a person holding a licence to promote, conduct and operate soccer football pools is required to pay into the prize fund an amount equal to the prescribed percentage of the subscriptions received by the licensee in respect of those pools. Clause 4 preserves the existing prescribed percentage of 50% (currently prescribed by clause 5 of the Soccer Football Pools (Application of Subscriptions) Regulation 1994, which Regulation is repealed by clause 6 of this Regulation);

(b)

unclaimed prizes: clause 5 requires licensees holding unclaimed soccer football pool prizes to publish certain particulars relating to such prizes of $50 or above in the Government Gazette. Clause 5 of the Lotto Regulation 1995 is similar;

(c) technical matters: clauses 1–3.

This Regulation is made under the Soccer Football Pools Act 1975, and in particular, under sections 14 (Application of subscriptions), 15 (Prize fund) and 21 (the general regulation-making power). It comprises matters of a machinery nature.
