1. This application requires an extension of time to seek leave to appeal the decision of the Court of Appeal of the Supreme Court of Western Australia (Buss P, Murphy and Mitchell JA). The appeal foreshadowed in the application does not give rise to an issue of public importance and has insufficient prospects of success to warrant a grant of special leave to appeal. Accordingly, there is no utility in granting the extension of time.  

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
