The Australian Fisheries Management Authority makes the following determination in accordance with a decision made by the Commissioners under section 23 of the Fisheries Administration Act 1991.

1  Name

This instrument is the Small Pelagic Fishery (Fishing Period) Determination 2021.

2  Commencement

This instrument commences on the day after this instrument is registered.

3  Authority

This instrument is made under subsection 17(6)(aa) of the Act and under subsection 10(1) of the Plan.

4  Definitions

(1)  In this instrument:

Act means the Fisheries Management Act 1991.

Plan means the Small Pelagic Fishery Management Plan 2009.

(2)  A term used in this instrument that is defined for the purposes of the Plan has the same meaning in this instrument as it has in that Plan.

Note:          Terms defined in the Fisheries Management Act 1991 have the same meaning in this instrument (see paragraph 13(1)(b) of the Legislation Act 2003). 

5  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

6  Determination of Fishing Period

The fishing period in the Small Pelagic Fishery is the period starting on 1 May in a year and ending on 30 April in the following year.
