AN ACT to amend the Small Claims Tribunals Act,

1974-1975.

[Assented to 12th November, 1976.I

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title

1. (1) This Act may be cited as the Small Claims

and citation.

Tribunals Act Amendment Act, 1976.

(2) In this Act the Small Claims Tribunals Act

1974-1975 is referred to as the principal Act.

(3)

The principal Act as amended by this Act may

be cited as the Small Claims Tribunals Act, 1974-

Section 8

amended.

2. Section 8 of the principal Act is amended

(a)

by inserting after the word "office" in line three the passage "except with the express permission of the Governor, which permis- sion may at any time be withdrawn"; and

(b)

by adding a subsection as follows

(2) Notwithstanding subsection (1), where a person holds office as a referee and also holds another public office for which he is remunerated out of the Con- solidated Revenue Fund of the State, the terms and conditions of office as a referee in respect of matters mentioned in para- graphs (b), (c), (d), and (g) of subsec- tion (1) do not apply to or in relation to that person in his office as a referee except to the extent that they are more favourable to him than the terms and conditions of his other public office in respect of like matters to those so men- tioned. .
