[A ssented to 7 th M ay , 1958.] S laughtering A ct A mendment AcT 0F 1958- E it enacted by the Queen’s Most Excellent Majesty, B by and with the advice and consent of the Legis­ lativeAssemblyof Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. (1.) This Act may be cited as The Slaughtering short title. Act Amendment Act of 1958.” (2.) *“ The Slaughtering Act of 1951,” is in this Act Principal referred to as the Principal Act. Act< (3.) The Principal Act and this Act may be Collective collectively cited as The Slaughtering Acts, 1951 to tltle' 1958.” 2. Subsection two of section five of the Principal Repeal of Act is repealed. 8‘5 (2)' Act i3s.amSuebnsdeecdti— on one of section six of the Princip r al Aofms.en6d(m1)e.nts (i.) By inserting, after the definition of the term “ Appliance ” therein, the following definition :— “ “ Approved ”—Approved by an inspector Approved. (ii.) By repealing the definition of the term “ Butcher’s shop ” therein and by inserting, in lieu of that repealed definition, the following definition :— “ “ Butcher’s shop ”—Any building (including any Butcher’s market, cold store, depot, shop, booth orshop- stall), enclosure, premises, or other place (or part of any place), with its appurtenances, kept or used for the storage of meat for sale, * 15 G. 6 No. 9.

No. 18, or for the preparation for sale or sale of meat, or for any purpose of or connected with the storage of meat for sale, or the preparation for sale or sale of meat, including the land appurtenant to any place (or part of any place) as aforesaid, and any vehicle kept or used for or in connection with the storage of meat for sale, or the preparation for sale or sale or carriage or delivery of meat, and any appliance declared by the Governor in Council by Order in Council to be a butcher’s shop: The term includes any building, enclosure, premises or other place (or part of a place) kept or used for the manufacture or preparation for sale of prescribed meats but does not include a small goods shop Inspector. (iii.) By repealing the definition of the term Inspector ” therein and by inserting, in lieu of that repealed definition, the following definition:— “ Inspector ”—The Chief Inspector or any other inspector appointed or deemed to be appointed under and for the purposes of this Act: The term includes any member of the Police Force and any other person acting under the direction or in aid of an inspector: The term also includes any inspector appointed under *“ The Stock Acts, 1915 to 1954 (iv.) By inserting in the definition of the term “ Offal ” therein, after the word “ horns ”, the symbol and words “, uncooked bones ” ; Prescribed meats. (v.) By inserting after the definition of the term “ Prescribed ” therein, the following definition :— “ “ Prescribed meats ”—Bacon, brawn, cooked meats, dripping, lard, ham, pies, pigs’ cheeks, pork bones, pork fillets, sausages, tinned meats and trotters: The term also includes any meats prescribed by the Governor in Council by Order in Council published in the Gazette in addition to or in substitution for any such meats * 6 G. 5 No. 16 and amending Acts.

By repealing the definition of the term “ Small goods shop ” therein and inserting, in lieu of that repealed definition, the following definition :— ““Small goods shop”—Any building, premises®“aUs°ods or other place (or part of any place), with °p’ its appurtenances, kept or used for the sale of any prescribed meat but not kept or used for the storage for sale, the preparation for sale, or the sale of meats other than prescribed meats or for the storage other than for sale or the manufacture or preparation for sale of prescribed meats: The term includes any place which is prescribed to be a small goods shop and (vii.) By adding to the definition of the term “ Vehicle ” therein the words “ : The term also includes any meat delivery box used on any such vehicle.” 4. Section eight of the Principal Act is amended —Amendment® (i.) By repealing the word “ and ” where appearing at the end of subparagraph (e) of subsection one of that section; (ii.) By adding to subsection one of that section the following subparagraph :— “ and (g) Call to his aid— (i.) Any member of the Police Force where he has reasonable cause to apprehend any obstruction in the exercise of his powers or in the execution of his duties ; (ii.) Any person he may think competent to assist him in making any inspection or examination.”; and (iii.) By adding to that section the following subsection :— 1 v 4.) An J y inspector who— inspector may require (i.) Finds any person committing or who name and reasonably suspects any person of having committed an offence against this Act; or (ii.) Is making investigations or inquiries with a view to establishing whether or not an offence against this Act has been committed by any person ; or s

Questions, with respect to matters under this Act, any person, may require such person to state his name and address or name or address and, if he has reasonable grounds to suppose that the name and address, or name or address, given is false, may require evidence of the correctness thereof. Any person required under this section— (a) To state his name and address or name or address who fails to state his name and address or, as the case may be, name or address, or states a false name and address or, as the case may be, a false name or false address ; (b) To give evidence of the correctness of his name and address, or name or address, who fails to give that evidence or who gives false evidence with respect to his name and address or, as the case may be, name or address, shall be guilty of an offence against this Act.” Amendments of s. 9. 5. Section nine of the Principal Act is amended— (i.) By repealing the word “ or ” where that word first appears in that section ; and (ii.) By repealing the words “ small goods shop ” wherever those words appear in that section. Amendment 6 . Section eighteen of the Principal Act is amended of s. is. by a(j(iing thereto the following subparagraph :— “ or (h) Use any abusive or insulting language to any inspector or to any other person with respect to any inspection or examination or questioning under this Act.” Amendment 7. Subsection one of section nineteen of the of s. 19 (i). principai Act is amended by repealing the words “ small goods shop ” wherever those words appear in that subsection. Amendments 8. Subsection one of section twenty-five of the of s. 25 (i). Principal Act is amended— (i.) By repealing in subparagraph (ii.) of the second paragraph of that subsection (being the paragraph commencing with the words “ Without limiting the

Slaughtering Act Amendment Act. generality ”) the words “ fees for such licenses or registrations, or for any class thereof, and for the renewal and transfer thereof or of any class thereof ” appearing therein; (ii.) By repealing the words “ small goods shops ” wherever those words appear in subparagraphs (ii.), (xi.), (xii.), (xiv.) and (xxi.) of the second paragraph of that subsection; (iii.) By repealing in subparagraph (vi.) of the second paragraph of that subsection the words “ small goods shop ” appearing therein ; (iv.) By adding to subparagraph (ix.) of the second paragraph of that subsection the following words “ including but without limiting the generality hereof providing that meat in the course of transport be accompanied by a transfer certificate or consignment note in or to the effect of the prescribed form signed by an inspector, requiring the production of any such certificate or consignment note to inspectors on demand, providing for the delivery of any such certificates or consignment notes on delivery of the meat and for the keeping or preservation of the same (v.) By adding to subparagraph (xi.) of the second paragraph of that subsection the following words :— “ providing for, and prescribing standards for, office and change room accommodation for use of inspectors at all or any slaughter­ houses or places in or on which stock are kept or sold for slaughtering for human consumption (vi.) By repealing subparagraph (xxiv.) of the second paragraph of that section and by inserting, in lieu of that repealed subparagraph, the following subparagraph:— “ (xxiv.) Prescribing fees payable under this Act on such basis or bases as the Governor in Council considers appropriate and the matters in respect of which such fees shall be paid (including but without limiting the generality hereof fees for any license or registration 547

No. 18, 1958. under this Act or for any class thereof, and for the renewal and transfer thereof or of any class thereof and al:o the imposition of fees for the purpose of the payment of expenses incurred by inspectors in making inspections or otherwise in the administration of this Act) and prescribing the persons by whom and the places and times when and where such fees shall be paid, and in lieu of fixing the amount or basis of calculation of any fee prescribed by the regulations to be payable in respect of any matter or class of matters hereinbefore mentioned in this subparagraph, providing for the fixation of the amount or basis of calculation of that fee by the Minister in which case the Minister may, subject to such limitations (if any) as may be prescribed, fix, in like manner, the amount or basis of calculation of that fee ; providing for the waiver of fees by the Minister either generally or in any matter or class of matters ; providing for the recovery of any amount of fees not duly paidand (vii.) By repealing the third paragraph of that section (being the paragraph commencing with the words “ The power to make any regulation under this Act ”) and, in lieu of that repealed paragraph, inserting the following paragraph :— “ The power to make any regulation under this Act shall include power to make that regulation so that it shall be of general or specially limited application according to persons, time, place, purposes, class or circumstances, or otherwise as is prescribed, and so that any regulation may or may not differ from any other regulation of specially limited application with respect to the same persons, matters or things.” Amendment 9. The First Schedule to the Principal Act is Socfhedule I. amended by inserting, after the word “ Mastitis ” therein, the word “ Melioidosis ” and also by inserting, after the word “ Septicaemia ” therein, the word “ Sparganosis
