11 LOCAL. PERSONAL. AND PRIVATE ACTS OF THE PARLIAMENT OF QUEENSLAND. 6° AND 7° GEO. VI. PARKS AND PUBLIC LANDS. An Act to Divest from the present Trustees thereof 73:'°i2: 1• certain Freehold Land, known as Blade p~ ~ ~ ~ ; » ~ y Park, situated within the Area of the City 1943. of Warwick, and to Vest such Land in the Council of the City of Warwick, and for purposes incidental thereto. [ASSENTED TO 29TH APRIL, 1943]. B E it enacted by the King's Most Excellent Majesty,. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled,. and by the authority of the same, as follows :- 1 This Act may be cited as " The Blade Park Act Short title. of 1943." ( 2 a . ) ITnhtehitseArmct"- trustees" means the persons and Itinotne.rpreta- each of them who, under the provisions of *" The Real Property Acts, 1861 to 1942," are, at the date of the passing of this Act, registered as the proprietors of the estate in fee-simple in the land described in the Schedule to this Act as trustees ; and (b) The term "Slade Park" means the land described in the Schedule to this Act. 3. (1.) No. 12, in the Council of the City of Warwick as proprietor of the estate in fee-simple therein upon and subject to the following trust, that is to say, upon trust for and for the purposes of a public recreation ground under the name of "Slade Park." (2.) All other property and assets of any kind whatsoever vested in the trustees for or for the purposes of the trusts for which the trustees held Slade Park shall be and are hereby divested from the trustees and transferred to and vested in the Council of the City of Warwick upon and subject to the trust referred to in subsection one of this section. Every person who has the possession or control of any property and assets hereinbefore mentioned in this subsection shall, and may, without authority other than this Act, do and execute all such acts, matters, and things as may be necessary to secure to the Council of the City of Warwick all such property and assets, together with all and every the right, title, estate, and interest therein. (3.) All the liabilities and obligations of the trustees in respect of Slade Park shall devolve and be imposed upon and shall be discharged by the Council of the City of Warwick. Title to 4. The Registrar of Titles shall, upon application in Slade Park. that behalf, made by or on behalf of the Council of the City of Warwick, register the said Council as the registered proprietor of an estate in fee-simple in the land described in the Schedule to this Act as trustee upon and subject to the trust referred to in subsection one of section three of this Act, but free of any trust upon and subject to which the trustees held such land, and for that purpose may issue any certificate of title and make such endorse- ments upon any certificate of title or deed of grant, and entries in the registers as may be necessary and proper. Slade Memorial Committee," shall pay to the Council of the ~ n~t~ a~ City of Warwick all moneys subscribed, collected, paid over ~ o contributed and raised.for the purpose of perpetuat~ g ~ ~ ~ o~ ft; l the memory of the saId W. B. Slade by a memorial of Warwick. fence enclosing Slade Park. Every member of such committee, or other person who has the control or possession of any such moneys (including the manager or principal officer of any bank to the credit of any account in which any such moneys have been deposited) shall and may, without authority other than this Act, pay such moneys to the said Council and the receipt of the Clerk of the said Council shall be a sufficient discharge to any such member or other person so doing, and he shall not be concerned to see to the application by the said Council of such moneys so paid to it by him. 7. (1.) All moneys which, pursuant to section six Application of this Act, are paid to the Council of the City of Warwick, hI t~oUncil shall be held by the said Council upon and subject to~ . B~ Slade the following trust, that is to say, upon trust for and ~ em; rial for the purpose of perpetuating the memory of the said un. W . .B. Slade by a memorial fence enclosing Slade Park. (2.) (a) The said memorial fence shall be erected by the said Council as soon as may be after His Majesty ceases to be engaged in War; (b) The Council of the City of Warwick shall consult the W. B. Slade Memorial Committee with reference to the type and design of fence to be erected before commencing the erection of such memorial fence; (c) The Council of the City of Warwick shall expend upon the erection of such memorial fence a sum not less than the amount of money paid to the said Council by the said committee; (d) Until expended by the Council of the City of Warwick for or for the purposes of the erection of such memorial fence, all moneys paid to the said Council by the W. B. Slade Memorial Committee shall be placed by the said Council to the credit of a separate trust fund and held in such fund: Provided that the said Council may invest any moneys for the time being standing to the credit of the said fund in debentures, stock, or other securities of the

No. 7, Government of Queensland or the Commonwealth of Australia, but every such investment shall be made with due regard to the purpose for which the fund is to be expended and the income from every such investment shall be paid into and form part of the fund. SCHEDULE. All that piece or parcel of land situated in the county of Merivale, parish of Warwick, city of Warwick, containing 4 acres 3 roods 8 35/100 perches, be the same more or less, being subdivision I of suburban allotment 2, resubdivision 2 of subdivisions II and 12 and resubdivision 2 of subdivision 16 of suburban allotment I of section 44 on Plans Catalogue Nos. 45819, 46789, and 46790, deposited in the Office of the Registrar of Titles, Brisbane, which said piece or parcel of land is the whole of the land ·described in Certificate of Title No. 334090, volume 1787, folio 80. W HEREAS certain land enumerated in the Schedule was demised by lease during the year one thousand nine hundred and seventeen by the then Council of the town of Windsor to an association or institution known as the Wilston School of Arts, for a period of ninety-nine years, at a peppercorn rental when demanded, and it was covenanted in the instrument of lease that the premises to be erected upon the said land were to be used as a school of arts and public hall and for no other purpose: And whereas a public meeting was subsequently held and moneys were raised sufficient to cover the erection of a public hall, and an institution styled the Wilston School of Arts. came into being with rules and regulations governing its constitution:
