1. The present case does not give rise to any issue of principle concerning the implications of the adversarial nature of a criminal trial for the conduct of the trial by the trial judge. The interests of justice in the individual case are not engaged. Special leave to appeal should be refused.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
