The court held that the notice of objection to competency was upheld and dismissed the appeal as incompetent. The Federal Court emphasised that the appellant had not demonstrated any basis for the appeal to be entertained by the Federal Court. The Minister’s notice of objection to competency was therefore valid and the appeal was dismissed with costs awarded to the Minister. The court made orders that the appeal be dismissed as incompetent and that the appellant pay the first respondent’s costs as assessed or agreed.
