The Court noted that the MRT had also failed to consider the evidence relating to domestic violence submitted by Mr Singh, which was a relevant consideration. The Court accepted Mr Singh's submission that the MRT's contradictory observations and failure to properly review the evidence constituted a failure to take into account relevant considerations and a failure to properly consider the facts, thereby amounting to jurisdictional error.
