CaseChat Overview and Summary

This matter concerned an application for review of a decision by the Migration Review Tribunal (the Tribunal) affirming the refusal to grant Mr Singh a Student (Temporary) (Class TU) visa. Mr Singh had applied for the visa while in Australia and did not hold a specified substantive visa at the time of application. The dispute centred on whether Mr Singh met the requirements of clause 572.211 of Schedule 2 to the Migration Regulations 1994 (the Regulations).

The primary legal issue before the court was whether the Tribunal had committed a jurisdictional error in its decision. Specifically, the court had to determine if the Tribunal's inadvertent reference to clause 573.211 instead of clause 572.211 in its consideration of Mr Singh's eligibility constituted a jurisdictional error, thereby vitiating its decision. This required an assessment of whether the Tribunal identified the wrong issue, asked the wrong question, ignored relevant material, or relied on irrelevant material in a way that affected its exercise of power.

The court noted that the Tribunal had correctly identified the relevant criteria under clause 572.211, which required that if an applicant is in Australia and does not hold a specified substantive visa, their last substantive visa must have been of a specified type (which a student visa was), and the application must have been made within 28 days of that visa ceasing to be in effect, or satisfying other conditions related to cancellation. The Tribunal found that Mr Singh's last substantive visa expired on 21 March 2012, and his current application was made on 28 July 2014, thus failing the 28-day requirement. The court acknowledged the Tribunal's typographical error in referencing clause 573.211, but held that this error did not amount to jurisdictional error because the Tribunal had otherwise correctly identified and applied the substantive requirements of clause 572.211 and considered the relevant evidence.

The court therefore concluded that the Tribunal's decision did not involve jurisdictional error and affirmed the Tribunal's decision to affirm the refusal of the visa.
