Application for relief from unfair dismissal - s.596 - reasons to be issued later.

[1] Mr Simon Paul has made an application pursuant to s.394 of the Fair Work Act 2009 (the Act) seeking relief from unfair dismissal. Mr Paul was employed by MPH Agriculture Pty Ltd (MPH).

[2] MPH has sought permission pursuant to s.596(2) of the Act to be represented by a lawyer in the arbitration proceedings in relation to the application. It seeks to have the question of permission resolved prior to the hearing.

[3] MPH made its application and set out reasons why permission should be granted on 31 August 2015. Mr Paul provided a response which set out his objections to permission being granted on 2 September 2015.

[4] On the basis of the information before me I am satisfied that the requirements of s.596(2)(b) are satisfied. I have therefore decided to exercise my discretion and grant permission to MPH to be represented.

[5] I shall issue my reasons for decision at a later date.
