CaseChat Overview and Summary
The court was required to determine whether the proposed enterprise agreement was properly certified as a simple, low risk, and genuine agreement. This involved examining whether the agreement covered all relevant employees, addressed the required matters, and was free from any provisions that contravened public policy. The court also needed to consider whether the agreement had been made in good faith and whether it provided for the protection of employees' rights and entitlements.
The Fair Work Commission found that the proposed agreement was properly certified and met the necessary criteria. The agreement covered all relevant employees, addressed the required matters, and contained no provisions that were contrary to public policy. The court was satisfied that the agreement had been made in good faith and provided for the protection of employees' rights and entitlements. As a result, the court approved the agreement.
The Fair Work Commission approved the Silk Contract Logistics Pty Ltd Fuchs Warehouse & National Union of Workers Enterprise Agreement 2013. The agreement is now legally binding on the parties and their employees. The decision of the court is final and binding, and cannot be appealed except on limited grounds.
