This Act may be cited as "The ShOlf'thand Re- porters in Oourts of Summary Jurisdiction.Act of 1915." Interpreta. 2. In this Act, unless the context otherwise indicates,. tion. the following terms have the meanings set against them respectively, that is to say,- Court of of Summary Jurisdiction. "Court of Summary tT urisdiction"-Any of the following Courts, namely:- (a) Small Debts Court; . (b) Court of Petty Sessions sitting for the hear- ing and determination of complaints of simple offences and breaches of duty under "The.Justices Acts, 1886 to' 1909";* (c) Licensing Court; (d) Warden's CO'urt. Reporter. "Reporter"-A shorthand reporter. ,apPO'inted under this Act for the 'purposes of this Act 01" any O'ther Act relating to' the taking, of evidence in legal proceedings. Power to appoint reporters. 3. The Governor in Council may from time to time,. for the purposes of this Act, appoint fit persons as short- hand reporters under this Act. All shorthand notes, together with all certified transcriptions thereof, made by any such reporter shall be the property O'f His Majesty. When 4. For the purposes of this section, proceedings shall mean the plea, the evidence, and any objections taken to the summons or other process, or in the course of the evidence, any directions asked for, and any points of law raised during the hearing, but shall not include any part of the speeches of counsel or solicitor. 5. (1.) The reporter who attends -the proceedings Reporter to> shall faithfully report such proceedings. ~ ~ ~ ~ dings. . (2.) Such report shall be made in shorthand, and shall in every case required by the presiding justice or any interested party include a transcription thereof~ which the reporter shall, as soon as practicable, make or cause to be made in longhand writing, typewriting, or in such other mode as is directed. (3.), Such transcription shall in every case bear a Certificate 8& certificate under the hand of the reporter that it is : ~ J; ~ k, ~ . a faithful transcription of the shorthand notes, and constitutes a faithful report of the proceedings whereof .it purports to be a report: Provided that where more reporters than one are engaged such certificate shall be given by each such reporter in respect of so much of the proceedings as have been reported or transcribed by him. (4.) Such shorthand notes, together with any certified Notes to be- transcription thereof, shall be filed with the other papers filed. in the proceedings. 6. Notwithstanding any enactment to the contrary, Witr:ess in all cases where it is prescribed by law that the dakrr:f· n deposition of a witness is to be read over to and signed n:~ ~ ~~ by him, it shall be sufficient, unless the witness other- sign: wise desires, if the reporter certifies as aforesaid that the shorthand notes of such deposition and the transcription thereof, if made, are correct without the deposition being read over to or signed by the witness. 9. (1.) Every person who, not being a reporter, Offences. directly or indirectly uses the name of a reporter, or

Any reporter who in any way- (a) Wilfully misreports any proceedings he is directed to report under this Act; or (b) Wilfully tampers with or falsifies any report made by him under this Act, or permits any other person so to do; or (c) Wilfully gives any false certificate as to the faithfulness of such report; is liable to a penalty not exceeding one hundred pounds, and, in addition thereto, in the discretion of the adjudi- cating Court, imprisonment with or without hard labour for any term not exceeding six months. Regulations. 10. The Governor in Council may from time to time make all such regulations as he deems necessary for all or any of the following purposes ;- (a) Examining as to tho fitness and qualifications of applicants for appointments as reporters; (b) Prescribing the duties of reporters; (c) Prescribing the system or systems of shorthand writing to be used by reporters, and the mode of transcribing the shorthand notes; (d) Securing as far as practicable uniformity' of system of reporting; (e) Regulating the mode in which reports made shall be preserved and made a permanent record of the proceedings ; (f) Fixing the fees to be paid in respect of reports, or of certified transcriptions, or in respect of any other specified matter relating to reporting, and for determining by whom such fees shall be payable; (g) And generally for any other purpose which he deems necessary in order to give full effect to this Act. ' . The regulations may provide a penalty not ex- ceedin.g twenty pounds for any contravention thereof. All such regulations, upon publication in the Gazette, shall be read as one with this Act and be of equal validity, and shall be judicially noticed. Such regulations shall be laid before the Legislative Council and Legislative Assembly within fourteen days

Labour Exchanges Act. after such publication if Parliament is in session, and, if not,' then within fourteen days after the commencement of the next session. If either House passes a resolution disallowing any such regulation, of which resolution notice has been given at any time within fourteen sitting days of either House after such regulation has been laid before it, such regulation shall thereupon cease to have effect, but with·· out prejudice to the validity of anything done in the meantime. 11.
