Alteration of other rules of organisation.

[1] On 12 August 2013, the Shop, Distributive and Allied Employees Association lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the Shop, Distributive and Allied Employees Association - Victorian Branch (the Victorian Branch).

[2]        The particulars set out alterations to Rules 5, 9, 20, 29, 34, 36, 38 and 39.

[3]        On 19 August 2013 and 25 September 2013, further information was provided about

whether the alterations had been made under the rules of the organisation.

[4] On 31 October 2013 the Victorian Branch consented to the amendment of the alterations for the purpose of correcting typographical, clerical or formal errors. Accordingly, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009, I amend the alterations as follows:

 In proposed rule 36(b), “Fair Work (Registered Organisations) Act 2009” is replaced
by Fair Work (Registered Organisations) Regulations 2009;

 In proposed rule 38(2)(i), “Fair Work (Registered Organisations) Act 2009” is

replaced by Fair Work (Registered Organisations) Regulations 2009; and

 In proposed rule 36(d), only delete the word “these”, which appears before the word
“members”, and substitute those.

[5]        On the information contained in the notice, I am satisfied the alterations have been

made under the rules of the organisation.

[6]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise

agreements, and are not otherwise contrary to law. I certify accordingly under subsection

159(1) of the Fair Work (Registered Organisations) Act 2009.
