Alteration of other rules of organisation.

1. On 18 July 2017 the Victorian Branch of the Shop, Distributive and Allied Employees Association lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the Branch.

1. The particulars set out alterations to rules 3, 5, 9, 10, 11, 23, 30, 35, 40 and 43. The alterations:

   ·   contain a new list of objects of the Branch;

   ·   specify that members of State Council and the Finance Committee can participate in meetings of those bodies via electronic means, with the President’s approval;

   ·   make minor amendments to rules concerning Divisions;

   ·   provide that State Council can deem membership to commence on a date earlier than the date it is accepted;

   ·   vary the publications in which the Returning Officer is required to advertise the calling of nominations; and

   ·   specify that contributions can be deducted from a credit/debit card.

1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
