Alteration of other rules of organisation.

1. On 16 July 2019, the Victorian Branch of the Shop, Distributive and Allied Employees Association (the Branch) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the Branch (the Branch Rules).

1. The particulars set out alterations to rules 23 and 42 of the Branch Rules.

1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

1. The alteration to rule 23 pertains to the manner in which applications for membership may be made and accepted and the alteration to rule 42 provides for the manner of calling nominations for the offices of Secretary/Treasurer and Assistant Secretary/Treasurer. The alteration to rule 42 appears to have been made in response to the Post-Election Report issued by the Australian Electoral Commission on 1 August 2018 with respect to the elections conducted in matter E2018/98.

1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
