An Act to vest in certain Officers of Customs in this Colony

certain powers which, by The Merchant Shipping

Act, 1871,' are, in the United Kingdom, vested in the

Board of Trade.

[Assented to 16th August, 1877.

HEREAS by section seven of The Merchant Shipping Act, Preamble

1871,' it is provided that the costs of any survey made in 344,- 35 vie.,

pursuance of the provisions of that section shall be paid in the first C. no

instance by the Board of Trade out of the Mercantile Marine Fund, and shall be repaid to the said Board, as in the said section mentioned ; and whereas the said provision is not applicable to the case of surveys made in pursuance of the said section in this Colony, and it is expedient to provide for such cases : Be it therefore enacted by His Excellency the Governor of Western Australia and its Dependencies, by and with the advice and consent of the Legislative Council thereof, as follows :—

the same repaid to him, by the person or persons upon whose demand or in consequence of whose allegation the survey was made, or by- the master or owner of the ship, in the same manner and subject to the same conditions as, within the United Kingdom, the Board of Trade is so entitled.
