Shipping Registration Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and pursuant to section 4 of the Acts Interpretation Act 1901,hereby make the following Regulations under the Shipping Registration Act 1981.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Shipping Registration Regulations.

Provisional certificates

2. Regulation 15 of the Principal Regulations is amended—

(a) by inserting in sub-regulation (1) “, or sub-section 22a (1), (2) or (6),”after “(6)”;

(b) by omitting from sub-regulation (2) “under sub-section 22 (1) of the Act” and substituting “by a proper officer under sub-section 22 (1) of the Act or by the Registrar under sub-section 22a (1) or (2) of the Act”;

(c) by inserting in paragraph (2) (a) “or the Registrar, as the case requires,” after “officer”;

(d) by omitting sub-paragraph (2) (a) (xv) and substituting the following sub-paragraph:

“(xv) details of any application, being an application for the registration of the ship under section 15 of the Act, that has been lodged in accordance with regulation 7; and”; and

(e) by inserting in paragraph (2) (b) “or the Registrar, as the case requires” after “officer”.

Extension of period of currency of provisional certificate

3. Regulation 16 of the Principal Regulations is amended by omitting “or 22 (4)” and substituting “, 22 (4) or 22a (4)”.

Schedule 2

4. Schedule 2 to the Principal Regulations is amended—

(a) by omitting from Form 3 the heading “CERTIFICATION” and substituting “CERTIFICATE”; and

(b) by omitting from Form 3 all the words from and including “Where the certificate is granted by a proper officer” and substituting—

“I, [name] , grant this provisional registration certificate in respect of the ship particulars of which are set out above under the Shipping Registration Act 1981 to [name, address and nationality of owner].

Schedule 3

5. Schedule 3 to the Principal Regulations is amended by inserting in Item 4 “or 22a” after “section 22”.
