SHIPPING AND PILOTAGE

AMENDMENT ACT

No. 65 of 1988

AN ACT to amend the Shipping and Pilotage Act 1967.

[Assented to 14 December 1988]

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the Shipping and Pilotage Amendment

Act 1988.

Commencement

2. This Act shall come into operation on the day on which it receives

the Royal Assent.

Principal Act

3. In this Act the Shipping and Pilotage Act 1967* is referred to as

the principal Act.

proclamation in the Gazette of 13 June 1986.]

Section 5 amended

4. Section 5 of the principal Act is amended in subsection (1)-

(a)

in paragraph (c) by deleting "and";

(b)

in paragraph (d) by deleting "therein." and substituting the following-

" therein; and "; and

(c)

by inserting after paragraph (d) the following paragraph-

" (e) control the movement of vessels in a prescribed control

area outside the port. ".

Section 9 amended

5. Section 9 of the principal Act is amended

(a)

by repealing subsection (1) and substituting the following

subsection-

"

charges as prescribed are payable for the use of pilotage(1) Subject to subsection (2) and section 12, pilotage

facilities by a vessel within a port or a prescribed pilotage

area outside a port. ";

(b)

in subsection (2) (a) by deleting "at any port" and substituting the following

"

within a port and a prescribed pilotage area outside a

port "; and

(c)

in subsection (2) (e) by deleting "entry, departure, or".

Validation

6. Any act or other thing done before the day on which this Act comes into operation that would have been lawful had this Act been in force when that act or other thing was done shall be deemed to be and to have been lawfully done and is hereby validated.
