AN ACT to provide for the Registration of Brands for

Sheep.

[Assented to, 17th August, 1871.]

HEREAS it is expedient, for the protection of owners of preamble.

it enacted by His Excellency the Governor of Western Australia

its Dependencies, by and with the advice and. consent of the

Legislative Council thereof, as follows:—

1 FROM and after the passing of this Act it shall be lawful for "Fire Brands" and " Wool

be burnt in upon certain part or parts of the face, to be fully stated in the Register; and the "Wool Brand" shall be stamped with pitch (or such other material as the person registering the said brand shall think fit) upon some part of the body of the sheep so to be branded, which shall be in the like manner fully stated in the said Register.

brand previously registered. a brand so registered is similar to any brand previously registered

under this Act, he shall order the person last registering such similar brand to make such a difference in his brand as may be necessary to prevent mistake or confusion therefroM; the particular alteration in such brand, however, to be determined by the person who registered the same, provided the Registrar of Brands shall be of opinion that such alteration will meet the object required. And if such person shall refuse to make such difference within four months after receiving notice from the Registrar of Brands requiring him to do so, unless further time be given by the Registrar of Brands upon reasonable grounds shown, such person shall be liable to forfeit and pay a sum not exceeding Five pounds.

THE Registrar of Brands shall from time to time, as soon as conveniently may be, publish in the Government Gazette the brand or brands registered under this Act up to the date of such publication, and the name of the person or persons registering the same; And any other person making use of a similar brand after such registration and publication thereof, shall be liable to a penalty not exceeding Fifty pounds.

THAT it shall be lawful for the Registrar of Brands to cancel any registered brands after six months' notice of his intention so to do, given by publication in the Government Gazette, provided no valid objection to such cancellation is made to him in writing by any person.

THAT it shall not be lawful to Register any numerical figure, or the letter • S as a " Wool Brand ;" And that such numerical figures or letter stamped upon sheep shall not be taken to be " Wool Brands" within the meaning of this Act.

Recovery of penalties, &c. 6 ALL informations and proceedings for the recovery of fines,

penalties, and costs under this Act, shall be heard and determined, and such fines, penalties, and costs shall be awarded and imposed in a summary way before any two or more Justices of the Peace.

Sections of "Shortening 7 SECTIONS A. E. G. I. of the "Shortening Ordinance,

Act to all intents and purposes, and in as full and ample a manner, as if the said Sections had been introduced and fully set forth in

this Act.

8 THIS Act may be cited as " The Sheep Branding Act, 1871." Short Title.
