TRill SHEARERS AND SUGAR WORKERS [ASSENTED TO 14TH DECEMBER, 1906.J AOCOMMODA- TION ACT B E it enacted by the King's Most Excellent Majesty, i~ Eg~ ~: ~ : by and with the advice and consent of the Legis- lative Oouncil and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1 This Act may be cited as "The Shearers andSllOrttitleand Sugar Workers Aooommodation Aot Amendment Aot of construction 1906," and shall be read as one with" The Shearers and of Act. Sugar Workers Aooommodation Act of] 905,"* hereinafter called the Principal Act. This Act and the Principal Act may together be cited as "The Shearer8 and Sugar Workers Aooommodation Aots, 1905-1906." 2. In subsection two of section seven of the Principal Amendment Act, the fo llowing words are omitted: "and whenever, P of r ~ m . c ~ l . p o a f l Act. ID the OpInIOn of an inspector, any damage or defacement has been done either by design or negligence by any such person, such inspector shall give to the employer a certificate to that effect." 3. After section nine of the Principal Act, the follow- ing sections are inserted :- . [9A.] Notwithstanding anything contained in this Temporary Act, in cases wher~ any owner or other ~erson having the ~i~c~ 1o~ ~!; ~r control of a holdmg, farm, or plantatIOn employs any workers in workers temporarily at such holding, farm, or plantation ~ ~ ~ ~ : ! t. for any cane cutting or other work usually performed by sugar workers, or where such owner or other person enters into an agreement with any person, herein called the contractor, for the performance temporarily at such hold- ing, farm, or plantation, by the contractor and workers directly employed by him, of any cane cutting or other work usually performed by sugar workers, and the con- tractor undertakes under such agreement to provide and * 5 Edw. Qualified exception in case of portable shearing plant. supply to his workers the temporary accommodation necessary in the execution of the work, the Regulations under this Act may prescribe the nature and extent of the temporary accommodation to be supplied by such owner or other person or such contractor to such workers, so that in all respects the health and well-being of such workers may be safeguarded. [9B.J Notwithstanding anything contained in this Act, in the case of the owner or other person having the control of a portable shearing plant and employing not more than fifteen shearers, exclusive of labourers, the Regulations under this Act may prescribe the nature and extent of the temporary accommodation to be supplied by such owner or person to such shearers and labourers, so that in all respects the health and well-being of such ~ hearers and labourers may be safeguarded. Amendment 4. The following words are added to section ten of of s. 10. the Principal Act, namely; "and any tent or other structure used for accommodating workers employed temporarily as in the last preceding section but one mention~ d. " 5. After section sixteen of the Principal Act, the following section is inserted ; - Regulations. [17.J The Governor in Council may from time to time make Regulations for all purposes which,in his opinion, are necessary to give effect to the purposes and intention of this Act. Such Regulations may be general in their application or may be limited to particular localities; premises, shearing-sheds, or sugar works. Such Regula- tions may provide a penalty not exceeding twenty pounds for any breach thereof. All such Regulations shall, upon publication in the Gazette, and not being contrary to the provisions of this Act, be of the same effect as if they were enacted in this Act, and shall be judicially noticed, and shall not be questioned in any proceedings whatsoever. o A f m s e . n 6 d . ment of th 6 e . In this Act, unless inconsistent with the context- Interpreta. "Contract price" includes the money payable for tion. the performance of any work under any contract, express or implied, and whether the price was fixed by express agreement or not; "Contractor," as regards an employer, means a person who contracts directly with the employer for the performance of work (including in such expression any material the property of the contractor used in connection with the work performed by him) for him; " Court" means the Court in which any proceeding may be taken under this Act, and includes the judge of any such Court, and, in the case of the Small Debts Court, a police magistrate and any two or more justices of the peace sitting in that Court; "Employer" means and includes any person by whom a contract is made with another person for the performance of work, or at whose request or upon whose credit or on whose behalf with his privity or consent work is done, and includes also all persons claiming under him whose rights are acquired after the work in question has commenced;
