Application for an unfair dismissal remedy – exceptional circumstances not found – extension of time not granted – application dismissed.

  1. Mr Shaun Massey (Applicant) made an application for an unfair dismissal remedy under s.394 of the Fair Work Act 2009 (Cth) (Act) on 28 October 2024. The application was made outside of the statutory 21-day time limit.[1] At the jurisdictional hearing earlier today and for reasons provided on the transcript, I found that there were no exceptional circumstances as set out by s.394(3) of the Act.

  1. Accordingly, the application was dismissed. An Order to that effect will be issued separately.
