CaseChat Overview and Summary
The primary legal issue before the court was whether the agreement complied with the procedural and substantive requirements for approval under the Fair Work Act. The court examined whether the agreement was certified as "no disadvantage" by the Fair Work Commission, whether the agreement was genuinely negotiated, and whether it met the other statutory requirements. The court also considered whether the agreement provided for a safety net of minimum entitlements for employees.
The court found that the agreement was certified as "no disadvantage" and was genuinely negotiated. The court also found that the agreement met all the statutory requirements and provided for a safety net of minimum entitlements for employees. The court held that the agreement was fair and reasonable, and approved the agreement. The court emphasised the importance of protecting the rights of employees and ensuring that employers and unions negotiate in good faith.
The court approved the SG Mining Pty Ltd Agreement (Greenbushes) 2020, subject to certain conditions.
