Sex Work Amendment Regulations 2022

The Administrator of the State of Victoria as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Sex Work Regulations 2016 as a consequence of the commencement of Part 3 of the Sex Work Decriminalisation Act 2022.

2Authorising provisions

These Regulations are made under sections 68 and 90 of the Sex Work Act 1994.

3Commencement

These Regulations come into operation on 10 May 2022.

4Principal Regulations

In these Regulations, the Sex Work Regulations 2016[1] are called the Principal Regulations.

5Amendment of regulation 1—Objectives

Regulation (1)(a), (d) and (e) of the Principal Regulations are revoked.

6Amendment of regulation 5—Definitions

(1)In the heading to regulation 5 of the Principal Regulations, for "Definitions" substitute "Definition".

(2)In regulation 5 of the Principal Regulations, the definition of business name is revoked.

7Heading to Part 2 amended

In the heading to Part 2 of the Principal Regulations, for "Health and safety" substitute "Safety".

8Regulation 6 revoked—Sexually transmissible infection

Regulation 6 of the Principal Regulations is revoked.

9Part 3 revoked—Advertising controls

Part 3 of the Principal Regulations is revoked.

10Part 4 revoked—Small owner operators

Part 4 of the Principal Regulations is revoked.

11Amendment of Schedule 2—Certificate of Registrar

In Schedule 2 to the Principal Regulations—

(a)omit "*section 24/";

(b)omit "*Delete if inapplicable".

12Amendment of Schedule 3—Infringement offences and infringement penalties

(1)Items 1, 3, 4, 5, 6 and 7 of Schedule 3 to the Principal Regulations are revoked.

(2)In item 2 of Schedule 3 to the Principal Regulations, for "17(1)(b)" substitute "17".
