687 w d1fok nwtslau^ ANNO VICESIMO TERTIO ELIZABETHAE SECUNDAE REGINAE No. 73 of 1974 An Act to amend The Sewerage, Water Supply, and Gasfitting Act of 1949 as subsequently amended in certain particulars [ASSENTED TO 1ST NOVEMBER, 1974] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Sewerage, Water Supply, and Gasfitting Acts Amendment Act 1974. (2) The Sewerage, Water Supply, and Gasfitting Act of 1949 as subsequently amended is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Sewerage and Water Supply Act1949-1974. 2. Commencement of Act. This Act shall commence on a date fixed by Proclamation.

The Principal Act is amended by, in the long title- (a) omitting the words " and to Make Provision for the Preparation of Standard By-laws in relation to Gasfitting "; (b) omitting the words " and, upon the Preparation of Standard By-laws in relation to Gasfitting, of Gasfitters ". 4. Amendment of s. 1. Section 1 of the Principal Act is amended by omitting the words " Sewerage, Water Supply, and Gasfitting " and substituting the words " Sewerage and Water Supply ". 5. Amendment of s. 3. Section 3 of the Principal Act is amended by- (a) omitting the reference " Part II-Standard By-laws in relation to Sewerage, Water Supply, and Gasfitting;" and substituting the reference " Part II-Standard By-laws in relation to Sewerage and Water Supply;"; (b) omitting the reference " Part 111-Constitution of the Plumbers, Drainers, and Gasfitters Examination and Licensing Board;" and substituting the reference " Part III-Constitution of the Plumbers and Drainers Examination and Licensing Board;". 6. Amendment of s. 4 . Section 4 of the Principal Act is amended by- (a) omitting the definition " Gas Company "; (b) omitting from the definition ".Interim License" the words Interim Drainer's License, or Interim Gasfitter's License " and substituting the words " or Interim Drainer ' s license "; (c) omitting from the definition " License " the words " Drainer's License, or Gasfitter's License " and substituting the words " or Drainer's License "; (d) omitting the definition " Minister " and substituting the following definition:- Minniisstteerr "-The Minister for Local Government and Electricity or other Minister of the Crown who at the material time is charged with the administration of this Act and includes any person who at the material time is performing the duties of the Minister;"; (e) omitting the definition " Standard By-laws " and substituting the following definition:- " " Standard By-laws "-The Standard Sewerage By-laws or the Standard Water Supply By-laws, as the case may be, made under Part II of this Act and as set forth at any material time in the First and Second Schedules respectively;"; (f) omitting the definition " Standard Gasfitting By-laws ". 7. New heading to Part II. The Principal Act is amended by omitting the heading appearing immediately before Section 5 and substituting the following heading:- STANDARD BY-LAWS IN RELATION TO SEWERAGE AND WATER SUPPLY ".

Section 6 of the Principal Act is amended by- (a) omitting subsection (3); (b) omitting from subsection (4) the words " (or,'if a Fourth Schedule is added to this Act in pursuance of the provisions of subsection three of section six of this Act, that Fourth Schedule)". 9. New heading to Part III. The Principal Act is amended by omitting the heading appearing immediately before section 7 and substituting the following heading:- CONSTITUTION OF THE PLUMBERS AND DRAINERS EXAMINATION AND LICENSING BOARD ". 10. Amendment of s. 7. (1) Section 7 of the Principal Act is amended by- (a) omitting subsection (1) and substituting the following subsection:- " (1) Constitution of the Board. For the purposes of this Act there shall be constituted a Board to be called " The Plumbers and Drainers Examination and Licensing Board."; (b) in subsection (2)- (i) omitting the words " eight members, as follows "; (ii) omitting provisions (ii) and (iii) and substituting the following provisions:- (ii) A representative of the Department of Education nominated in that behalf by the Minister for Education and Cultural Activities; (iii) A representative of the Department of Health nominated in that behalf by the Minister for Health;"; (iii) omitting from provision (iv) the word "Authorities " where it secondly occurs and substituting the word " Government "; (iv) omitting provisions (vii) and (viii). (2) The term of appointment as a member of the Board (constituted under the Principal Act as at the commencement of this Act) of any person representative of Gas companies or of any person representative of the Department of Mines shall cease upon the commencement of this Act. (3) The commencement of this Act shall not affect the validity or continuance of any Gasfitter's License in force at the commencement of this Act issued by the Board as constituted at any time under the Principal Act. 11. Amendment of s. 9. Section 9 of the Principal Act is amended by- . (a) inserting after the words " Water Plumber's License;" the word " and "; (b) omitting the words- " ; and (v) On and after the coming into operation of the Fourth Schedule- a Gasfitter's License ".

690 Sewerage , Water Supply, and Gasfitting Acts Amdt Act 1974, No. 73 12. Amendment of s. 10 . Section 10 of the Principal Act is amended by omitting subsection (4). 13. Amendment of s. 11 . Section 11 of the Principal Act is amended by- (a) omitting subsection (5); (b) omitting from subsection (6) the words " a Water Plumber's License, a Drainer's License, or a Gasfitter's License " and substituting the words " a Water Plumber's License, or a Drainer's License ". 14. Amendment of s. 15. Section 15 of the Principal Act is amended by- (a) omitting from subsection (1) all words commencing with the words " Standard Water Supply By-laws " to the end of the subsection and substituting the following words: " Standard Water Supply By-laws and the Standard Sewerage By-laws."; (b) omitting subsection (5). 15. Repeal of and new s. 16. The Principal Act is amended by repealing section 16 and substituting the following section:- " 16. Offences by persons not holding appropriate licenses, etc. (1) From and after the coming into operation of the First Schedule and the Second Schedule, a person shall not at any time perform any work governed by the provisions of- (i) The Standard Sewerage By-laws; or (ii) The Standard Water Supply By-laws, unless at that time he is the holder of a License or Interim License which entitles him under this Act to perform that work. A person guilty of an offence against this section shall be liable to a penalty not exceeding $40.00. (2) The provisions of subsection (1) do not apply to- (a) a person executing any work consisting merely of the excavation and/or backfilling of trenches or any other work of an unskilled nature; or (b) an apprentice, as defined by the Apprenticeship Act 1964-1972, who performs any work under the direct supervision of a person holding a License or Interim License which entitles such license holder under this Act to perform that work.". 16. Amendment of s. 17. Section 17 of the Principal Act is amended by omitting from provision (ii) of subsection (1) the words " or Gas Company ". 17. Repeal of Schedule IV. The Principal Act Is amended by omitting Schedule IV.
