Sewerage Rates (Amendment) Act 1978 (ACT)

AN ORDINANCE

To amend the Sewerage Rates Ordinance 1968

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

SEWERAGE RATES (AMENDMENT) ORDINANCE 1978

1. This Ordinance may be cited as the Sewerage Rates (Amendment)

Ordinance 1978.*

2. In this Ordinance, "Principal Ordinance" means the Sewerage Rates Ordinance 1968.t

3. Section 4 of the Principal Ordinance is amended by omitting from sub-section (1) the definition of " Oaks Estate ".

4.   Section 5 of the Principal Ordinance is amended—

(a)	by omitting from sub-section (1) "Subject to this section, for the purpose" and substituting " F o r the purposes"; and
(b)	by omitting sub-section ( 3 ) .

5. Section 5A of the Principal Ordinance is repealed.

6.   Section 6 of the Principal Ordinance is amended—

(a) by omitting from paragraph (1) (e) "or in sub-section (3) ";

(b) by omitting from sub-section (2) ", not being a parcel of land situated at Oaks Estate,"; and

(c) by omitting sub-section ( 3 ) .

7. Section 7 of the Principal Ordinance is amended by omitting

" and additional sewerage rates ".

8. Sections 8 A and 8 B of the Principal Ordinance are repealed.

9. Section 9 of the Principal Ordinance is amended by omitting

sub-section ( 2 ) .

10.   Section 10 of the Principal Ordinance is amended—

(a) by omitting from sub-section (1) "other than a Class 6 or Class 7 parcel of rateable land "; and

(b) by omitting sub-sections ( 3 ) , ( 4 ) , ( 5 ) , (6 ) and ( 7 ) .

11.  Section 13 of the Principal Ordinance is amended—

(a)	by omitting from paragraph (1) (a) "other than a Class 6 or Class 7 parcel of rateable land ";
(b)	by omitting sub-section ( 3 A ) ; and
(c)	by omitting from sub-section (4) " and additional sewerage rates (if any) " (wherever occurring).

12.  Section 14 of the Principal Ordinance is amended—

(a)	by omitting from sub-section (1) "or additional sewerage rates "; and
(b)	by omitting from sub-section (1) "or additional rates" (wherever occurring).

13. Section 19 of the Principal Ordinance is amended by omitting

from sub-section (1) " o r additional sewerage rates ".

14. Section 20 of the Principal Ordinance is amended by omitting

" and additional sewerage rates ".

15. Section 23 of the Principal Ordinance is amended by omitting

" o r additional sewerage r a t e s " (wherever occurring).

16. Section 24 of the Principal Ordinance is amended by omitting

sub-section ( 4 ) .

17.  Section 27 of the Principal Ordinance is amended—

(a) by omitting from sub-section (1) "or additional sewerage rates ";

(b)	by omitting from sub-section (2) "or additional sewerage rates "; and
(c)	by omitting from sub-section (3) "or additional sewerage rates ".

18. The Schedule to the Principal Ordinance is repealed.

19. The Principal Ordinance is amended as set out in the follow­

ing table:

20. (1) The Principal Ordinance, as amended by this Ordinance,

applies to and in relation to sewerage rates imposed in respect of the

rating year that commenced on 1 July 1978 and each subsequent rating year.

(2) The Principal Ordinance, as in force immediately before the commencement of this Ordinance, continues to apply to and in relation to sewerage rates and additional sewerage rates imposed in respect of a rating year that commenced before 1 July 1978.

(3) An expression in this section that is defined in the Principal Ordinance has the same meaning for the purposes of this section as it has in the Principal Ordinance.
