AN ORDINANCE

To amend the Sewerage Rates Ordinance 1968.

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

SEWERAGE RATES (AMENDMENT) ORDINANCE 1977

1. This Ordinance may be cited as the Sewerage Rates
(Amendment) Ordinance 1977.*

2. In this Ordinance, " Principal Ordinance " means the Sewerage

3.   Section 4 of the Principal Ordinance is amended-—

(a) by inserting in sub-section (1), before the definition of " flushed sanitary fixture ", the following definitions:—

" 'appropr ia te officer' means the person declared by the Minister, by notice published in the Gazette, to be the appropriate officer for the purposes of this Ordinance;

'Depar tment ' means the Department of State adminis­ tered by the Minister of State for the time being administering this Ordinance;";

(b)

by inserting in sub-section (1), after the definition of " rating year ", the following definition:—

" 'Secretary ' means the person who, for the time being, is, or is performing the duties of, the Permanent Head of the Department within the meaning of the Public Service Act 1922;"; and

(c) by omitting from sub-section (2) the words " of the Depart­ ment of Works ".

4. Section 5A of the Principal Ordinance is amended by omitting from sub-section (3) the words " a person occupying, or performing the duties of, the office of The Director of Housing and Construction, Aus­ tralian Capital Territory, in the Department of Housing and Construc­ tion " and substituting the words " the appropriate officer ".

5.   Section 6 of the Principal Ordinance is amended—

(a) by omitting from sub-paragraph (1) ( d ) ( i ) the word " or " (second occurring); and
(b) by inserting after sub-paragraph ( l ) (d ) ( i i ) the following word and sub-paragraph:—

" o r (iii) if the land is held by the Canberra College of Advanced Education under a lease granted under he Canberra College of Advanced Education (Leases) Ordinance 1977,".

6.   Section 8 of the Principal Ordinance is amended—

(a)

by omitting sub-paragraphs (l) (d) (i) and (l) (d) (ii) and substituting the following sub-paragraphs:—

" (i) in a case where not more than 2 flushed sanitary

fixtures are situated on the parcel—$40.80; and

(ii)   in any other case—an amount equal to the sum of $40.80 and an amount calculated at the rate of $20.40 for each flushed sanitary fixture situated on

the parcel in excess of 2 flushed sanitary fixtures;
and "; and

(b)

by omitting from sub-paragraph (1) (e) (ii) the word " or " and substituting the word " and ".

7. Section 11 of the Principal Ordinance is amended by omitting

from sub-section (5) the words " of the Department of Works ".

8. Section 13 of the Principal Ordinance is amended by omitting

from sub-section (3) the words " of the Department of Works ".

9. Section 19A of the Principal Ordinance is amended by omitting

sub-section (4) and substituting the following sub-section:—

" (4 ) In this section, ' quarter day ' means the last day of March,

June, September or December.".

10.   Section 24 of the Principal Ordinance is amended—

(a)

by omitting from sub-section (1) the words " to the Depart­ ment of the Interior "; and

(b)

by omitting from paragraph 3 (b) the words "to the Department of the Interior ".
