s1 2 s6 Sewerage and Water Supply Amendment (No. 1) No. 340, 1996 ˙ Short title 1. This regulation may be cited as the Sewerage and Water Supply Amendment Regulation (No. 1) 1996 . ˙ Commencement 2. This regulation commences on the day the Environmental LegislationAmendment Act (No. 2) 1995 , section 24, commences. ˙ Regulation amended 3. This regulation amends the Standard Sewerage Law. ˙ Amendment of s 2 4.(1) Section 2(1), definition “Trade wastes” omit . (2) Section 2(1)— insert— “trade waste” see section 17A of the Act;’. ˙ Amendment of s 33 5. Section 33, the words “and such liquid trade wastes”— omit . ˙ Replacement of s 34 6. Section 34— omit, insert ˙ Prohibited substances 34.(1) This section prescribes prohibited substances for section 17A of the Act. (2) For the definition “trade waste” , a prohibited substance is a

(3) For section 17A(2) of the Act— (a) a prohibited substance, for discharge into sewerage, is a substance mentioned in the schedule, part 1; and (b) a prohibited substance, for discharge into stormwater drainage, is a substance mentioned in the schedule, part 2. ˙ Costs of repairing damaged sewerage 34A.(1) This section applies if— (a) in contravention of section 17A of the Act, a person discharges a prohibited substance into sewerage; and (b) the discharge causes damage to sewerage. (2) The local government in whose local government area the sewer is located may perform work to fix the damage and recover the reasonable costs for the work from the person who discharged the prohibited substance. (3) The costs mentioned in subsection (2) are in addition to any penalty imposed for the discharge.’. ˙ Amendment of s 35 7.(1) Section 35, all words from ‘The owner of any premises’ to ‘the Council in respect of such permit.’— omit. (2) Section 35, second sentence ‘The owner’— omit, insert— ‘The owner or occupier’. (3) Section 35, fourth last sentence ‘owner’— omit, insert— ‘owner or occupier’. (4) Section 35, second last sentence ‘the provisions of this By-law’—

After table 32 (located after section 187)— insert— ˙ Postponed law commencement 188.(1) In this section— “postponed law” means StatuteLawRevisionAct(No.2)1995 , schedule 1, amendments of SewerageandWaterSupplyAct1949 , amendment 11. (2) The period before automatic commencement, under the ActsInterpretation Act 1954 , section 15DA(2), of the postponed law is extended to 29 November 1997. (3) This section expires on 30 November 1997. SCHEDULE PROHIBITED SUBSTANCES FOR SECTION 17A OF ACT section 3 PART 1—PROHIBITED SUBSTANCES FOR SEWERAGE 1. A solid or viscous substance in a quantity, or of a size, that can obstruct a

Examples of solids or viscous substances that are prohibited substances if of a size or in the quantity mentioned in item 1— ash, cinders, sand, mud, straw and shavings metal, glass and plastics paper and plastic dishes, cups and milk containers whether whole or ground by garbage grinders rags, feathers, tar and wood whole blood, paunch manure, hair and entrails oil and grease. 2. A flammable or explosive solid, liquid or gaseous substance (including petrol). 3. Floodwater, rainwater and stormwater, and roof water, seepage water, subsoil water and surface water. 4. A substance capable alone, or by interaction with another substance discharged into sewerage, of— (a) inhibiting or interfering with a sewage treatment process; or (b) causing a hazard for humans or animals; or (c) creating a public nuisance; or (d) creating a hazard in waters into which it is discharged; or (e) contaminating the environment in places where effluent or sludge from a sewage treatment plant is discharged or reused. 5. A substance with a pH lower than 6.0, or having another corrosive property capable of causing damage or a hazard to structures, equipment or persons. 6. A substance at a temperature of more than 40˚C or a higher temperature approved by a local government administering section 17A of the Act.

A solid or viscous substance in a quantity, or of a size, that can obstruct a stormwater drain, or interfere with the operation of stormwater drainage. Examples of solids or viscous substances that are prohibited substances if of a size or in the quantity mentioned in item 1 are as follows— ash, cinders, sand, mud, straw and shavings metal, glass and plastics paper and plastic dishes, cups and milk containers rags, feathers, tar and wood whole blood, paunch manure, hair and entrails oil and grease. 2. A flammable or explosive solid, liquid or gaseous substance (including petrol). 3. Sewage. 4. A substance capable alone, or by interaction with another substance discharged into stormwater drainage, of— (a) inhibiting or interfering with stormwater drainage; or (b) causing a hazard for humans or animals; or (c) creating a public nuisance; or (d) creating a hazard in waters into which it is discharged; or (e) contaminating the environment in places where stormwater is discharged or reused. 5. A substance with a pH lower than 6.0, or having another corrosive property capable of causing damage or a hazard to structures, equipment or persons. 6. A substance at a temperature of more than 40˚C or a higher temperature approved by a local government administering section 17A of the Act.’.
