2 Sewerage and Water Supply Amendment (No. 1) No. 97, 1994 ˙ Short title 1. This regulation may be cited as the Sewerage and Water Supply Amendment Regulation (No. 1) 1994 . ˙ Commencement 2. This regulation commences on 26 March 1994. ˙ Amended regulation 3. This regulation amends the Standard Sewerage Law 1981 . ˙ Insertion of new s 3A (Sewerage map to be kept) 4. After section 3— insert— ˙ ‘Sewerage map to be kept ‘3A.(1) A local government must keep a map showing— (a) the limits of the local government’s sewered area; and (b) the location of the local government’s sewers. ‘(2) The local government must allow anyone to inspect the map, without charge, during office hours of the local government. ’. ˙ Omission of s 28 (Delegation by Council) 5. Section 28— omit . ˙ Replacement of s 173 (Effluent storage tanks) 6. Section 173— omit, insert—
3 Sewerage and Water Supply Amendment (No. 1) No. 97, 1994 ˙ ‘Storage tanks ‘173.(1) A local government, by written notice, may require the owner of land outside a sewered area to install— (a) a sewage storage tank to hold sewage from the land; or (b) an effluent storage tank to hold effluent from the land. ‘(2) The person must comply with the notice. ‘(3) Unless the local government otherwise specifies in the notice, section 172 (Design and construction of septic tanks) applies to the design and construction of a sewage or effluent storage tank as if it were a septic tank. ‘(4) A person must not install— (a) a prefabricated sewage or effluent storage tank— (i) of a type or manufacture not authorised by the Joint Committee; or (ii) in a way not complying with the Joint Committee’s conditions for the tank’s use; or (b) a sewage or effluent storage tank of a design that does not prevent it floating when it is empty and ground water is close to the surface. Maximum penalty—40 penalty units. ’. ˙ Amendment of s 182 (Disposal of effluent) 7.(1) Section 182, heading, after ‘effluent’— insert ‘and sewage’. (2) Section 182(2)— omit ‘ an effluent ’, insert ‘ a sewage or effluent ’. (3) Section 182— insert— ‘(2A) However, the local government may, by written notice, require the owner of land outside a sewered area to dispose of sewage, other than
4 Sewerage and Water Supply Amendment (No. 1) No. 97, 1994 human faecal matter or urine, on the land by a specified system of on-site sewage disposal. ‘(2B) The person must comply with the notice. Maximum penalty—40 penalty units. ‘(7) In subsections (1) and (4)— “septic tank” includes a sewage storage tank. ’. ˙ Insertion of new Part 10A (Stormwater drainage) 8. After Part 10— insert— ‘PART 10A—STORMWATER DRAINAGE ˙ ‘Local government may require stormwater to be discharged to its stormwater drainage ‘186A.(1) This section applies if a local government provides stormwater drainage for premises in its area. ‘(2) The local government may, by written notice, require the owner of land within a specified reasonable distance of the local government’s stormwater drainage to discharge stormwater from the premises into the local government’s drains within a specified time, in a specified way, and subject to specified conditions. ‘(3) The person must comply with the notice. Maximum penalty—40 penalty units. ˙ ‘Approval required to connect ‘186B. A person must not connect stormwater drainage to a local government’s stormwater drain without the local government’s approval. Maximum penalty—40 penalty units.
5 Sewerage and Water Supply Amendment (No. 1) No. 97, 1994 ˙ ‘Sewerage and stormwater drainage to be separate ‘186C. A person must not connect sewerage to a stormwater drain. Maximum penalty—40 penalty units. ˙ ‘Interference with path of stormwater ‘186D. A person must not restrict the flow of stormwater in a way that may cause the water to collect and become stagnant or offensive. Maximum penalty—40 penalty units. ’. ENDNOTES 1.
