This order in council may be cited as the Sewerage and Water Supply Amendment Order 1992 . Amended by-laws 2. The Standard Water Supply By-laws set out in Schedule 2 to the Actare amended as set out in this order in council.
2 Sewerage and Water Supply Amendment Order 1991 No. 63, 1992 Amendment of by-law 2 (Definitions) 3. By-law 2— insert “AS 3500” means Australian Standard 3500—National Plumbing and Drainage Code; “backflow prevention device” means a fitting that— (a) provides complete protection against the reversal of the flow of water along a supply pipe, from a source capable of polluting the water; and (b) satisfies the requirements of AS 3500; ’. Amendment of by-law 8 (Pollution) 4.(1) By-law 8 (second sentence)— omit no direct connection ’, insert a minimum air gap that complies with AS 3500 ’. (2) By-law 8 (proviso to second sentence)— omit, insert If it is impracticable to provide a minimum air gap that complies with AS 3500, the engineer may approve the installation on the supply pipe of a backflow prevention device of a type, and in accordance with conditions, specified by the engineer. ’. (4) By-law 8 (fourth sentence—commencing “If in the opinion”)— after by reason of ’, insert the use to which the premises are put, or ’. (5) By-law 8 (fourth sentence)— after of such premises ’, insert to install a backflow prevention device of a type specified by the engineer, in the place specified by the engineer, or ’. 3 Sewerage and Water Supply Amendment Order 1991 No. 63, 1992 Insertion of new by-law 8A 5. After by-law 8— insert— ‘Maintenance, inspection and testing of backflow prevention devices ‘8A.(1) The owner of an installed backflow prevention device must ensure that the device is maintained in working order and is inspected for operational functioning at least once a year. ‘(2) A backflow prevention device that is— (a) a reduced pressure zone device, a double check valve assembly, or a pressure type vacuum breaker; or (b) a break tank or a device that provides an air gap that, under AS 3500, requires registration; must not be installed unless the Council has established a program for device registration and certification and the device is recorded in the Council’s register under the program. ‘(3) The owner of an installed backflow prevention device must, if directed in writing by the engineer, cause the device to be inspected and tested within the time specified in the direction and, if necessary, repaired or replaced by a licensed plumber approved by the Council. ‘(4) The licensed plumber who inspects and tests a backflow prevention device must give the Council the results of the inspection and test within 14 days. ‘(5) If the owner fails to comply with the direction, the Council may cause the device to be inspected and tested and, if necessary, repaired or replaced, at the owner’s expense. ’. Amendment of by-law 17A (Fees for water supply plumbing plans and inspections) 6. By-law 17A— after paragraph (1), insert— (m) Inspection or testing of backflow prevention devices. ’.
