Service Victoria (Transfer of Functions) Amendment (Working with Children) Regulations 2019

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Service Victoria (Transfer of Functions) Regulations 2018—

(a)to change the title of those Regulations; and

(b)to update the transferred customer service functions and transferred identity verification functions.

2Authorising provision

These Regulations are made under section 58 of the Service Victoria Act 2018.

3Commencement

These Regulations come into operation on 5 December 2019.

4Principal Regulations

In these Regulations, the Service Victoria (Transfer of Functions) Regulations 2018[1] are called the Principal Regulations.

5Title of Principal Regulations amended

In the title to the Principal Regulations, after "Transfer of" insert "Working with Children".

6Definition

(1)For the heading to regulation 4 of the Principal Regulations substitute—

"Definitions".

(2)  In regulation 4 of the Principal Regulations insert the following definition—

"mobile application means a software application designed for use on a personal electronic device such as a mobile phone or a handheld computing device;".

(3)At the end of regulation 4 of the Principal Regulations insert—

"(2)On and from the commencement of the Service Victoria (Transfer of Functions) Amendment (Working with Children) Regulations 2019, a reference to the Service Victoria (Transfer of Functions) Regulations 2018 in an instrument made under any Act or in a document of any kind is to be read as a reference to the Service Victoria (Transfer of Working with Children Functions) Regulations 2018 unless the context otherwise requires.".

7Schedule 1—Transferred customer service functions

(1)  In Column 2 of Item 1 in the Table in Schedule 1 to the Principal Regulations, paragraph (a) is revoked.

(2)Item 2 in the Table in Schedule 1 to the Principal Regulations is revoked.

(3)In the Table in Schedule 1 to the Principal Regulations, for "Department of Justice and Regulation" (wherever occurring) substitute "Department of Justice and Community Safety".

(4)In the Table in Schedule 1 to the Principal Regulations, after "Internet site" (wherever occurring) insert "or a mobile application".

8Schedule 2—Transferred identity verification functions

(1)In Column 2 of Item 1 in the Table in Schedule 2 to the Principal Regulations, paragraph (a) is revoked.

(2)Item 2 in the Table in Schedule 2 to the Principal Regulations is revoked.

(3)In the Table in Schedule 2 to the Principal Regulations, for "Department of Justice and Regulation" (where twice occurring) substitute "Department of Justice and Community Safety".

(4)In the Table in Schedule 2 to the Principal Regulations, after "Internet site" (wherever occurring) insert "or a mobile application".

(5)In Column 3 of Item 4 in the Table in Schedule 2 to the Principal Regulations insert "Secretary to the Department of Justice and Community Safety".
