Service Victoria (Miscellaneous) Amendment Regulations 2024

The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY

1Objective

The objective of these Regulations is to make consequential amendments to regulations made under the Service Victoria Act 2018 as a result of the enactment of the Service Victoria Amendment Act 2024 and the Justice Legislation Amendment Act 2022, and the making of the Dangerous Goods (Explosives) Regulations 2022.

2Authorising provision

These Regulations are made under section 58 of the Service Victoria Act 2018.

3Commencement

These Regulations come into operation on 29 May 2024.

PART 2—SERVICE VICTORIA (TRANSFER OF WORKSAFE VICTORIA FUNCTIONS) REGULATIONS 2021

4Objectives

(1)In regulation 1(b) of the Service Victoria (Transfer of WorkSafe Victoria Functions) Regulations 2021[1], for "2018; and" substitute "2018.".

(2)Regulation 1(c) of the Service Victoria (Transfer of WorkSafe Victoria Functions) Regulations 2021 is revoked.

5Definitions

(1)In regulation 4 of the Service Victoria (Transfer of WorkSafe Victoria Functions) Regulations 2021, in the definition of blasting explosives licence—

(a)for "125" substitute "126";

(b)for "2011²" substitute "2022[2]".

(2)In regulation 4 of the Service Victoria (Transfer of WorkSafe Victoria Functions) Regulations 2021, in the definition of explosives driver licence, for "2011" substitute "2022".

(3)In regulation 4 of the Service Victoria (Transfer of WorkSafe Victoria Functions) Regulations 2021, in the definition of fireworks licence—

(a)for "to be held to use fireworks under" substitute "under regulation 142 of";

(b)for "2011" substitute "2022".

6Regulation 7 revoked

Regulation 7 of the Service Victoria (Transfer of WorkSafe Victoria Functions) Regulations 2021 is revoked.

7Schedule 1—Transferred customer service functions

In Schedule 1 to the Service Victoria (Transfer of WorkSafe Victoria Functions) Regulations 2021, in Column 2 of item 1—

(a)in paragraphs (a), (b), (c), (d), (e) and (f), for "2011" substitute "2022";

(b)in paragraphs (a), (c) and (e), for "174(1)" substitute "175(1)";

(c)in paragraphs (b), (d) and (f), for "208" substitute "211".

PART 4—SERVICE VICTORIA (TRANSFER OF DISABILITY SERVICE SAFEGUARDS FUNCTIONS) REGULATIONS 2020

11Objectives

(1)In regulation 1(b) of the Service Victoria (Transfer of Disability Service Safeguards Functions) Regulations 2020[4], for "2018; and" substitute "2018.".

(2)Regulation 1(c) of the Service Victoria (Transfer of Disability Service Safeguards Functions) Regulations 2020 is revoked.

Regulation 7 of the Service Victoria (Transfer of Disability Service Safeguards Functions) Regulations 2020 is revoked.

PART 5—SERVICE VICTORIA (TRANSFER OF BIRTHS, DEATHS AND MARRIAGES IDENTITY VERIFICATION FUNCTIONS) REGULATIONS 2021

14Regulation 1 substituted

For regulation 1 of the Service Victoria (Transfer of Births, Deaths and Marriages Identity Verification Functions) Regulations 2021[5] substitute—

"1   Objective

The objective of these Regulations is to prescribe identity verification functions that are transferred to the Service Victoria CEO under the Service Victoria Act 2018.".

15Regulation 6 revoked

Regulation 6 of the Service Victoria (Transfer of Births, Deaths and Marriages Identity Verification Functions) Regulations 2021 is revoked.

16Schedule 1—Transferred identity verification functions

(1)In Schedule 1 to the Service Victoria (Transfer of Births, Deaths and Marriages Identity Verification Functions) Regulations 2021, in Column 2 of items 1, 2, 3 and 5, for "an entry" substitute "any entry".

(2)In Schedule 1 to the Service Victoria (Transfer of Births, Deaths and Marriages Identity Verification Functions) Regulations 2021, after item 1 insert—

"1A Collecting identity information provided with an application for the Registrar to search the Register for any entry about a birth and adoption under sections 45 and 45A of the Births, Deaths and Marriages Registration Act 1996, and verifying the applicant's identity if the application is made by input into an Internet site or a mobile application maintained for that purpose Registrar".

17Schedule 2 revoked

Schedule 2 to the Service Victoria (Transfer of Births, Deaths and Marriages Identity Verification Functions) Regulations 2021 is revoked.

PART 6—SERVICE VICTORIA (TRANSFER OF PROFESSIONAL ENGINEERS REGISTRATION FUNCTIONS) REGULATIONS 2021

18Regulation 1 substituted

For regulation 1 of the Service Victoria (Transfer of Professional Engineers Registration Functions) Regulations 2021[6] substitute—

"1   Objective

The objective of these Regulations is to prescribe identity verification functions that are transferred to the Service Victoria CEO under the Service Victoria Act 2018.".

For regulation 1 of the Service Victoria (Transfer of Miscellaneous Licensing and Registration Identity Verification Functions) Regulations 2022[8] substitute—

"1   Objective

The objective of these Regulations is to prescribe identity verification functions that are transferred to the Service Victoria CEO under the Service Victoria Act 2018.".

25Regulation 6 revoked

Regulation 6 of the Service Victoria (Transfer of Miscellaneous Licensing and Registration Identity Verification Functions) Regulations 2022 is revoked.

26Schedule 2 revoked
