Serious Offenders Amendment Regulations 2025

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Serious Offenders Regulations 2018—

(a)to make changes consequential to the enactment of the Corrections Legislation Amendment Act 2025; and

(b)to update references to the Department of Justice and Community Safety.

2Authorising provision

These Regulations are made under section 349 of the Serious Offenders Act 2018.

3Principal Regulations

In these Regulations, the Serious Offenders Regulations 2018[1] are called the Principal Regulations.

4Definitions

In regulation 4 of the Principal Regulations, the definition of Department is revoked.

5New regulation 4A inserted

After the heading to Part 2 of the Principal Regulations insert—

4APrescribed authorised person or body for information sharing"

For the purposes of paragraph (zn) of the definition of authorised person in section 3 of the Act—

(a)the Agency within the meaning of the National Disability Insurance Scheme Act 2013 of the Commonwealth is a prescribed body; and

(b)any person or body that delivers services or advice in relation to the National Disability Insurance Scheme within the meaning of the National Disability Insurance Scheme Act 2013 of the Commonwealth is a prescribed person or body (as the case requires).".

6Prescribed persons allowed to operate remotely piloted aircraft or helicopter

In regulation 20(a) of the Principal Regulations, after "Department" insert "of Justice and Community Safety".

7Regulation 23 revoked

Regulation 23 of the Principal Regulations is revoked.

8Forms amended

In Forms 1, 2, 3, 4, 5, 6, 7, 8, 11, 12, 13 and 14 of the Principal Regulations, for "and Regulation" substitute "and Community Safety".
