Part 1—Preliminary

1—Short title

These regulations may be cited as the Sentencing (Arraignment Date) Variation Regulations 2019.

2—Commencement

These regulations come into operation on the day on which the Sentencing (Miscellaneous) Amendment Act 2018 comes into operation.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Sentencing Regulations 2018

4—Variation of regulation 6—Prescribed modifications relating to sentencing discounts when ex officio information laid (section 40)

1. Regulation 6(1), inserted subsection (3)(a)(i)—delete "defendant's arraignment appearance" and substitute:

   first date fixed for the arraignment of the defendant

2. Regulation 6(1), inserted subsection (3)(a)(i)—delete "arraignment" second occurring and substitute:

   date

3. Regulation 6(1), inserted subsection (3)(a)(ii)—delete "defendant's arraignment appearance" and substitute:

   first date fixed for the arraignment of the defendant

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
