McHUGH J:   This application was considered by Justices Brennan, Dawson and myself.  We are of opinion that there is no error of law apparent in the judgment of the Court of Criminal Appeal.  An appeal in this case does not enjoy sufficient prospects of success to warrant a grant of special leave.  Accordingly, we dismiss the application for an extension of time in which to apply for special leave to appeal.
