Short title

1. These regulations may be cited as the Seeds Regulations, 1986.

Revocation of prior regulations

2. All regulations previously made under the Act (see Gazette 21 July, 1983, p. 174, 26 April, 1984, p. 1013 and 24 January, 1985 p. 242) are revoked.

Interpretation

3. (1) In these regulations—

"the Act" means the Seeds Act, 1979;

"the Department" means the Department of Primary Industries;

"inert matter" means inert matter ascertained in accordance with the rules of the International

Seed Testing Association;

"vendor" means a person who sells seeds in the course of a business.

(2) In these regulations—

(a)

seeds of a leguminous species are described as "fresh" if they remain dormant when subjected to the germination test;

(b)

seeds of a leguminous species are described as "hard" if they remain unswollen when subjected to the germination test.

Seeds to which the Act applies

4. The Act applies to seeds of every species of plants except ornamental flowers and trees.

Noxious organisms and noxious seeds

5. (1) The ryegrass toxicity organism, Anguina funesta, Price, Fisher and Kerr is a noxious

organism. (2) Seeds of the species set out in schedule 1 are noxious seeds.

Section 7 statement

6. (1) The statement to be furnished in pursuance of section 7 of the Act—

(a)

must be in the English language;

(b)

must be easily legible;

and

(c)

if printed, must be printed in print of a size of at least 8 points.

(2) Seeds of the species set out in schedule 2 are seeds of prescribed species for the purposes of section 7(3)(ac) of the Act and where a particular quantity of seeds includes seeds of one or more of those species, the statement must—

(a)

specify each of those species;

and

(b)

specify the proportion (expressed as a number per unit mass) constituted by seeds of each of those species.

(3) For the purposes of section 7(3)(b) of the Act—

(a)

the proportion of seeds of a particular species that might reasonably be expected to germinate shall be determined in accordance with the rules of the International Seed Testing Association;

and

(b)

fresh or hard seeds of a leguminous species shall not be regarded as seeds that might reasonably be expected to germinate.

(4) Where seeds have been treated with a fungicidal or insecticidal seed dressing, the statement must include a warning in the following form:

"CAUTION—TREATED WITH ........... (here insert the name ..... which may appear as the brand name or the recognized common name ..... of the fungicidal or insecticidal agent with which the seeds have been treated) DO NOT USE FOR FOOD, FEED OR OIL.".

(5) Where a particular quantity of seeds includes seeds of species other than a principal species (as defined by section 7(8) of the Act), the statement must specify the proportion (expressed as a percentage of total mass) constituted by the seeds of non-principal species.

(6) For the purposes of section 7(5a) of the Act, the information supplied in a statement given under section 7 of the Act must conform with the tolerances prescribed by the International Seed Testing Association.

(7) For the purposes of the definition of "principal species" in section 7(8) of the Act the prescribed percentage is—

(a)

in relation to turf mixtures—1%;

(b)

in relation to all other mixtures—5%.

(8) In a statement given in pursuance of section 7 of the Act seed species may be identified either by the recognized common name of the species or by the botanical name of the species.

Exemption

7. (1) Where seeds are sold in a parcel with a net mass of less than—

(a)

in the case of vegetable or herb seeds—the mass shown in schedule 3;

(b)

in the case of lawn or turf seeds—10 kilograms;

(c)

in the case of seeds for agricultural or pastoral use—25 kilograms,

the vendor is exempted from the provisions of section 7 of this Act in relation to the sale.

(2) Where seeds of a species referred to in Schedule 4 are not to be used for germination or propagation, the vendor is exempted from the provisions of section 7 of the Act in relation to the sale.

(3) The Minister may, by notice published in the Gazette

(a)

grant an exemption from all or any of the provisions of section 7;

or

(b)

vary or revoke an exemption previously granted under this subregulation.

(4) An exemption under subregulation (3)—

(a)

may operate by reference to—

(i)

species of seeds;

(ii)

quantities of seeds;

(iii)

any other factor or combination of factors;

and

(b)

may be subject to such conditions as the Minister thinks fit.

(5) Where an exemption is granted conditionally, a vendor is not entitled to the benefit of the exemption unless the condition is complied with.

Branding of Parcel

8. (1) Where seeds are contained in a parcel, the parcel must be branded with a code or mark identifying the seed lot from which the seeds come.

(2) A vendor who sells a parcel of seeds that is not branded as required by subregulation (1) is guilty of an offence.

Qualifications of Analyst

9. For the purposes of section 10 of the Act, the prescribed qualifications for an analyst are

as follows:

(a)

a degree or diploma in botany, or following specialization in botany, awarded by an Australian tertiary education institution;

(b)

an Australian Seed Testing Proficiency Certificate awarded by the Australian Seeds Committee of the Standing Committee on Agriculture or some other qualification approved by the Standing Committee as equivalent to that certificate.

Mass of seeds

10. In determining the mass of a particular quantity of seeds for the purposes of these regulations, the seeds shall be deemed to have a total mass equivalent to the mass of the seeds and of any inert matter mixed with the seeds.

Sampling and analysis of seeds

11. In the sampling and analysis of seeds for the purposes of the Act, the rules of the International Seed Testing Association must be observed.

Seed analysis service

12. Fees payable for the seed analysis service provided by the Department are set out in

Schedule 5.

Proof of the Rules, etc., of the International Seed

Testing Association

13. (1) For the purposes of the Act and these regulations, the rules and determinations of the International Seed Testing Association shall be determined by reference to Seed Science and Technology and the other official publications of the Association.

(2) A book, magazine or document purporting to be a publication of the International Seed Testing Association may be accepted by any court as evidence of the rules and determinations of the International Seed Testing Association.

(3) In any proceedings for an offence against the Act, an allegation made by the prosecution that the rules of the International Seed Testing Association were observed in relation to the sampling or testing of the seeds to which the proceedings relate shall, in the absence of proof to the contrary, be accepted as proved.

Interpretation

1. In this Schedule—

"certificate of analysis" means a certificate issued by the Department as to tests conducted by the

Department and the results of those tests;

"International Certificate" means a certificate as to purity and germination issued by the Department

with the authority of the International Seed Testing Association;

"ISTA" means the International Seed Testing Association.
