This instrument is the Security of Critical Infrastructure (Definitions) Amendment Rules (LIN 22/021) 2022.

2Commencement

This instrument commences on the day after registration.

3Amendment

Schedule 1 amends Security of Critical Infrastructure (Definitions) Rules (LIN 21/039) 2021.

8Critical freight infrastructure asset

1. (1)

   For paragraph 12B(4)(a) of the Act, an intermodal transfer facility at a location mentioned in an item of Schedule 1 that is owned or operated by the entity mentioned in the item is critical to the transportation of goods between:

   (a) 2 States;

   (b) a State and a Territory; or

   (c) 2 Territories; or

   (d) 2 regional centres.

2. (2)

   For paragraph 12L(18)(e) of the Act, the entity mentioned in an item of the table in Schedule 1 is the responsible entity for the asset mentioned in the item.

18Relevant Commonwealth body

1. (1)

   For paragraph 30BF(a) of the Act, the Department is specified as a relevant Commonwealth body.

2. (2)

   Subsection (1) only applies for subsections 30BC(5) and 30BD(5) of the Act.

   NoteFor other provisions in Part 2B of the Act, the relevant Commonwealth body is ASD.
