Security Industry Act 1997
Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Security Industry Act 1997.

Explanatory note
The object of this Regulation is to amend the Security Industry Regulation 2007 so as:
| (a) | to expand the Security Industry Council so that it includes a member who is a police officer nominated by the Commissioner of Police, and |
| (b) | to exempt from the operation of the Security Industry Act 1997 all persons employed by Rail Corporation New South Wales who are engaged in security activities (currently only persons employed in the Security Division of that corporation are exempted), and |
| (c) | to replace an obsolete reference to the “Ministry for Police”. |
This Regulation is made under the Security Industry Act 1997, including sections 6, 43A and 48 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Security Industry Amendment (Security Industry
Council and Exempt Persons) Regulation 2009.
2 Commencement
This Regulation commences on the day on which it is published on the
NSW legislation website.
3 Amendment of Security Industry Regulation 2007
(1) Clause 42 Security Industry Council: section 43A (2) Omit “12” from clause 42 (2). Insert instead “13”.
(2) Clause 42 (2) (b) Omit “11”. Insert instead “12”. (3) Clause 42 (4) (a) Omit “Ministry for Police”. Insert instead “Law Enforcement and Security Coordination Division,
Department of Premier and Cabinet”.(4) Clause 42 (4) (b1) Insert after clause 42 (4) (b):
(b1)
1 representative of the NSW Police Force (being a police officer who has been nominated by the Commissioner),
(5) Clause 42 (5) Omit “(4) (a) or (b)”. Insert instead “(4) (a)–(b1)”. (6) Schedule 1 Exempt persons Omit “in the Security Division of” from clause 1. Insert instead “by”.
