Seamen’s War Pensions and Allowances Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Seamen’s War Pensions and Allowances Act 1940.

Commencement

1. These Regulations shall come into operation on 1 November 1982.

Medical treatment for widows, &c.

2. Regulation 34 of the Seamen’s War Pensions and Allowances Regulations is amended by omitting “sub-section (2) of section 27” and substituting “section 17b or sub-section 27 (2)” in the definition of “child” in sub-regulation (2).

3. Division 3 of Part IV of the Seamen’s War Pensions and Allowances Regulations is repealed and the following Division substituted:

“Division 3—Education Benefits for Children

Education scheme

“35. The Commission shall establish a scheme for providing facilities for the education and training of a child—

(a) where a parent of that child is in receipt of a pension under section 22a of the Act;

(b) where a parent of that child, being an Australian mariner, has died as a result of a war injury; or

(c) where that child is entitled to receive a pension under section 17b of the Act.

Education benefits

“36. The Commission may make such arrangements and pay such amounts as it deems necessary for the care and education of a child in order to assist that child with its education where that child qualifies for the benefit of the scheme specified in regulation 35.”.

Funeral expenses

4. Regulation 38 of the Seamen’s War Pensions and Allowances Regulations is amended by omitting “$400” and substituting “$500”.

Clothing allowance

5. Regulation 38a of the Seamen’s War Pensions and Allowances Regulations is amended—

(a) by omitting from Column 2 of the table in sub-regulation (1) “3.60”, “1.70” and “2.40” (wherever occurring) and substituting “4.00”, “1.90” and “2.60” respectively;

(b) by omitting from sub-regulation (2) “$3.60” (wherever occurring) and substituting “$4”; and

(c) by omitting from sub-regulation (4) “$44.20” and substituting “$49.40”.

Application

6. (1) The amendment effected by regulation 4 applies in respect of funeral expenses of persons whose deaths occur on or after 1 November 1982.

(2) The amendments effected by paragraphs 5 (a) and (b) apply in respect of an instalment of an allowance falling due on 11 November 1982 and to all subsequent instalments.

(3) The amendment effected by paragraph 5 (c) applies in respect of an amount payable on or after 11 November 1982.
