Seamen’s War Pensions and Allowances

An Act to amend the Seamen’s War Pensions and Allowances Act 1940–1965.

[Assented to 30 September, 1966]

BE it enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:—

Short title and citation.

1.—(1.) This Act may be cited as the Seamen’s War Pensions and Allowances Act 1966.

(2.) The Seamen’s War Pensions and Allowances Act 1940–1965 is in this Act referred to as the Principal Act.

(3.) The Principal Act, as amended by this Act, may be cited as the Seamen’s War Pensions and Allowances Act 1940–1966.

Commencement

2. This Act shall come into operation on the day on which it receives the Royal Assent.

Rates of pension on death or total incapacity.

3. Section 18 of the Principal Act is amended by omitting from sub-section (4a.) the words “Twenty pounds five shillings” and inserting in their stead the words “Forty-two dollars fifty cents”.

Regulations.

4. Section 59 of the Principal Act is amended—

(a) by inserting in paragraph (g)of sub-section (1.), after the word “children”, the words “under the age of twenty-one years”; and

(b)by omitting sub-section (5.) and inserting in its stead the following sub-section:—

“(5.) In this section—

‘children’, in relation to an Australian mariner, means sons, daughters, step-sons, stepdaughters, adopted sons or adopted daughters of the mariner, and includes any ex-nuptial children of the mariner;

 

‘medical treatment’ means any treatment with a view to restoring a person to, or maintaining a person in, physical or mental health or alleviating suffering, and includes—

(a)any accommodation, nursing care or transport in relation to such treatment; and

(b)the supply, renewal and repair of artificial replacements and surgical and other aids and appliances.”.

5. The First Schedule to the Principal Act is repealed and the following Schedule inserted in its stead:—

Amendments in relation to decimal currency.

6.—(1.) The Principal Act is amended as set out in the First Schedule to this Act.

(2.) The Second Schedule to the Principal Act is repealed and the Schedule set out in the Second Schedule to this Act inserted in its stead.

(3.) The Fifth Schedule to the Principal Act is repealed and the Schedule set out in the Third Schedule to this Act inserted in its stead.

Application of amendments.

7. In so far as an amendment made by this Act affects instalments of pensions, the amendment applies in relation to an instalment of pension falling due on the first pension pay day after the date of commencement of this Act and to all subsequent instalments.
