Seamen’s War Pensions and Allowances Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Seamen’s War Pensions and Allowances Act 1940,

Repeal of regulation 9

1. Regulation 9 of the Seamen’s War Pensions and Allowances Regulations is repealed.

Repeal of regulations 14, 15, 16 and 17

2. Regulations 14, 15, 16 and 17 of the Seamen’s War Pensions and Allowances Regulations are repealed.

Attendance allowance

3. Regulation 33 of the Seamen’s War Pensions and Allowances Regulations is amended by omitting from sub-regulation (2) “46a (2)” and substituting “74a (2)”.

Application of certain provisions of the Repatriation Regulations

4. Regulation 38b of the Seamen’s War Pensions and Allowances Regulations is amended—

(a) by omitting from sub-regulation (1) “, 72”; and

(b) by omitting from sub-regulation (2) “72” and substituting “72a”.

Repeal of regulation 39

5. Regulation 39 of the Seamen’s War Pensions and Allowances Regulations is repealed.

Repeal of regulation 42a

6. Regulation 42a of the Seamen’s War Pensions and Allowances Regulations is repealed.

7. Regulation 43 of the Seamen’s War Pensions and Allowances Regulations is repealed and the following regulation substituted:

Exercise or performance by Commission of powers or functions of Deputy Commissioner

“43. (1) A power or function given by these Regulations to a Deputy Commissioner may be exercised or performed by the Commission.

“(2) Where the exercise of a power, or the performance of a function, by a Deputy Commissioner under these Regulations is dependent upon the opinion or belief of the Deputy Commissioner in relation to a matter, that power may be exercised, or the function may be performed, by the Commission upon the opinion or belief of the Commission in relation to the matter.

“(3) For the purposes of sub-regulation (2), ‘Commission’ includes, in relation to a power or function delegated by the Commission under section 57a of the Act, the person to whom that power or function has been delegated.”.
