Seamen's Compensation Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Seamen's Compensation Act 1911.

1.   Commencement

1.1 These Regulations commence on 13 December 1992.

2.   Amendment

2.1 The Seamen's Compensation Regulations are amended as set out in these Regulations.

3. Regulation 118

(Amounts prescribed for the purposes of certain provisions of the Act)

3.1 Table

Omit the Table,

 substitute:

4 .   Regulation 119 (Amounts prescribed for the purposes of clause (1) (a) (i) of Schedule 1 to the Act)

Omit “$74, 630”, substitute “$75, 080”.

4.2  Paragraph (b):

Omit “$29.90”, substitute “$30.10”.

5.   Regulation 120 (Amount prescribed for the purposes of subparagraph (1) (b) of Schedule 1 to the Act)

5.1 Omit “$239.90”, substitute “$241.30”.

6.    Application

6.1 The Seamen’s Compensation Regulations as amended by these Regulations apply to:

• (a)

  weekly payments of compensation under the Seamen’s Compensation Act 1911 for any period commencing after 12 December 1992; and

• (b)

  payments of compensation (other than weekly payments) under the Act for:

  • (i)

    an injury sustained, or disease suffered, by a seaman after 12 December 1992; or

  • (ii)

    a loss or event that occurs after 12 December 1992 resulting from any other injury sustained, or disease suffered, by a seaman.
