The Agreement is a single enterprise agreement.
[2] The Applicant has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.

The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

The Commission examined the process through which the agreement was negotiated, the content of the agreement, and whether it provided for fair and reasonable terms and conditions. The evidence presented showed that the negotiation process was conducted in good faith, with both parties engaging in meaningful discussions. The agreement itself was analysed to determine if it provided employees with a fair and reasonable set of terms and conditions. The Commission considered whether the agreement provided a balance between the interests of the employer and the employees, ensuring that it met the "better off overall" test.
The Fair Work Commission found that the agreement was made in good faith and met the "better off overall" test. The Commission approved the Enterprise Agreement 2017, determining that it provided fair and reasonable terms and conditions of employment for the employees at Scotch College Adelaide.
